The father of a 10-month-old boy who died in July, apparently after having not eating for several days, was arrested Thursday and charged with four counts of child neglect, an arrest affidavit said.

Kyle Lee Marsh Rupert, 22, of Avon Park, was arrested by the Highlands County Sheriff's Office and charged with one count of child neglect with great harm and three counts of child neglect without great harm. The arrest came two days after deputies arrested Sandra Michelle Jackson, 25, the mother of the four children, on the same charges.

Those arrests came six months after investigators and emergency medical technicians found the baby, Milo Rupert, dead on July 7, 2012. They also found the baby and three siblings lived in a filthy residence infested with cockroaches and garbage, arrest affidavits said. Neither arrest report stated a cause of death for Milo. However, authorities saw no evidence of blunt force trauma. The reports noted that authorities were not notified of the situation for several hours after the baby's death.

The reports also did not say who called for assistance, but indicated the mother was at work at the time. At the time of the baby's death, Milo had an "overall emaciated appearance" and it appeared that Milo "had not eaten for several days," the arrest affidavit for Rupert said. The baby also suffered from having "extensive insect bites resulting in a large segment of Victim 1's (Milo) epidermis (outer) skin layer eaten away during an extended unsupervised period of time," the affidavit said.

Of the four children, Milo is listed as the only child of Rupert, the affidavit said. The three surviving children appeared malnourished, the affidavit said. "Each victim was found to be poorly clothed, poorly fed, unwashed to the point of suffering from skin disorders and suffering from similar insect bites as Victim 1 (Milo)," the affidavit said. The affidavit said the investigators found that the residence of the children was in total disarray, the floors were soiled with spoiled food, garbage cans overflowed and that bedding was soiled

A mother accused of neglecting her four children to the point where one died of malnutrition was convicted Friday of aggravated manslaughter of a child and three counts of neglect after a three-day trial.

A Highlands County Circuit Court jury acquitted Sandra Jackson of one count of child neglect, as in the case of the child who died, 9-month-old Milo Rupert, they could only convict her of either the more serious charge of manslaughter or neglect.

The jury deliberated less than two hours before reaching a verdict. The jury on Friday heard closing arguments.

Assistant State Attorney Richard Castillo said that day after day Jackson would return home from work and see her children getting thinner, the cockroaches crawling all over their apartment and the increasing dirtiness, a prosecutor told a jury Friday.

Yet, she did “nothing or next to nothing,” to resolve those problems and protect the children depending on her, Castillo told the jury.

And that’s why Jackson should be convicted of aggravated manslaughter of a child, Castillo said.

Jackson and Kyle Rupert, both of Avon Park, were charged last year with three counts of child neglect without great harm, one charge of child neglect with great harm and one count of aggravated manslaughter of a child. That was after an autopsy showed that Milo had died of malnutrition and his three sisters were malnourished.

Kyle Rupert subsequently plead guilty and was sentenced to 24 years in prison.

Earlier Kyle Rupert testified that he did nothing to cause Milo’s death and he did his best to take care of Milo and the other children.

“I cared about him and my daughter and I could never hurt him,” he said. “I did my best. She (Sandra Jackson) did her best.”

But, Timothy Reichersamer, who lived with Jackson and Rupert, during part of 2012, said that he had to practically nag Rupert to check on his son.

the medical examiner stated that “due to there being no food in the child’s digestive track, he had not eaten in approximately three days,” a report said. It was also discovered that Milo “had large areas on his legs where German roaches had been gnawing on his flesh,” the report said. Reports also noted that an investigator arrived at the home on July 7 and saw that “several individuals were standing by the front door, laughing and appeared to be joking around. One of the individuals was later identified as the father, Kyle Rupert.” When the investigators arrived, the mother was not present, although she had let work around 1 a.m., the report said. The reports said Jackson arrived home at around 5 a.m. It gave some conflicting information about the mother’s reaction. While it noted that at one point the mother was crying, the investigator “noted never having heard the mother ask what had happened to Milo or get upset at the father what had happened.” Jackson did say she was in a relationship with another man because Rupert didn’t do any work at the home, the report said. Through interviews with Jackson, investigators determined that she “was not taking any responsibility for her home or children’s condition.” The three children surviving children were placed in the custody of Jackson’s aunt and uncle, Roy and Amy Jackson. Amy Jackson told authorities that during the ride from Sebring to their home, she changed the diapers of the children and was “appalled” when she saw a roach crawl out of one of the child’s vaginal areas. She has said in the months since then the children’s conditions have improved markedly. The parents had pleaded not guilty to the charges of neglect and aggravated manslaughter.
