The sheriff’s office in Matagorda County said a man is facing a capital murder charge in connection with a shooting involving his young son.

Lt. James Orr said deputies were dispatched to a shooting in the Frost Mobile Home Community around 3 a.m. Tuesday. The victim was a six-year-old boy and the boy’s father, Jacob Graves, 30, was arrested and charged with capital murder.

“I would’ve never thought this would’ve happened,” said former neighbor Cody Hudson.

Hudson and his daughters stopped by the property to drop off flowers for the family. They said the little boy’s name was Phillip.

“He was energetic. He was fun. He was very quiet but he was very loving. He and my daughter were thick as thieves,” said Hudson.

Lt. Orr said Rangers are helping with the investigation and still interviewing people.

Capital murder is punished with either a life sentence without parole or the death penalty, while murder is punished with a prison term of 5 to 99 years or life imprisonment.

Capital Murder in Texas

Nine different kinds of homicide qualify as capital murder in Texas:
  • The victim is a peace officer or fireman acting under their lawful duty at the time of the offense;
  • The defendant intentionally commits the murder during the commission or attempted commission of a kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat;
  • The defendant is paid to commit the murder or pays someone else to commit the murder;
  • The murder occurs during an escape from a penal institution;
  • An inmate, while incarcerated murders another A) who is an employee in prison operation, or B) with the intent to establish, maintain, or participate in a combination or in the profits of a combination;
  • An inmate, while incarcerated for either capital murder or murder, A) kills another, or B) an inmate serving a life sentence or a term of 99 years for kidnapping, assaultive offenses, or aggravated;
  • The defendant murders more than one person A) during the same criminal transaction, or B) during different criminal transactions but the murders are committed pursuant to the same scheme or course of conduct;
  • The defendant murders a child under six years of age; or
  • The defendant murders another person in retaliation for or on account of the service or status of the other person as a judge or justice.

I am Phillip's aunt. Actually his mother's aunt. Anyhow, none of you know what happened that night. It's very painful for the family, and especially on the first anniversary of his passing. Our family has lost several of our young sons in these last few years. Please share some love, prayers, and grace instead of your assumption of what you think might have happened.

@Donny and Dawn - we're not here to spread misery. We're here to discuss these cases and possibly vent some of our own frustrations/pain over our own past abuses. It seems shocking if you don't know that part of the equation. Really, we're on the side of the victims in these cases. I hope this helps you see us for what we are, a group of people concerned for and about the victims of abuse. :shame:

He was a handsome boy. I'm sorry for your loss. I hope the story you know from Philip's father is true. I'd far rather know he wasn't murdered by his own father.

So on the eve of your nephews death, you are googling articles about his murder? Please understand that here, we have all of the love prayers and grace for little Phillip, but we are fresh out for Dad. Tell me, how does a 6 year old get "accidentally shot" at 3am by their father?

Graves waived trial by jury and was sentenced to life in prison for the first degree felony by 23rd District Court Judge Denise Fortenberry.
