Tyler Thomas Acker, 27, will spend a total of seven and a half years to 25 years in state prison for assaults on his two young children ages 1 month and 5 years.
President Judge John Spataro sentenced Acker to serve six years and nine months to 20 years in state prison for a charge of aggravated assault with serious bodily injury for injuries Acker inflicted on the 1-month-old girl. Acker was given 230 days of pre-sentence jail credit.
Acker then was sentenced by Spataro to serve nine months to five years in state prison for endangering the welfare of a child for injuries inflicted on his 5-year-old daughter. The judge ordered the sentence to run consecutive to the aggravated assault sentence.

According to the arrest affidavit filed by state police in the baby’s case, the child’s injuries were so severe she was placed in critical condition at UPMC Children’s Hospital in Pittsburgh. She sustained brain and facial injuries consistent with severe trauma, including bleeding on and around the brain, damaged brain tissue and seizures, the affidavit said.
Acker told police that prolonged lack of sleep over the weekend as his daughter experienced intermittent fevers led him, in frustration, to grab her by the zipper of her onesie and forcefully rip her from her bassinet, whipping her head back and forth in the process, according to the affidavit.


After grabbing her from the bassinet, he threw her onto the nearby bed and then threw her across the bed, the affidavit said. After she rolled several times from the force of the throw, Acker told police that he forcefully threw a bottle that struck her in the head.
The police investigation into the infant’s injuries resulted in a separate case against Acker in which he was charged with assaulting his older daughter. The 5-year-old was found to have a bruise on her forehead that Acker told police he could have caused when the child was in the backseat of his vehicle. Acker told police the 5-year-old was acting out so he reached back and struck her, according to the affidavit in that case.

In addition to the total seven-and-a-half-year to 25-year sentence, Spataro also ordered Acker to have no contact with either child while they are minors.

He needs to do the entire 25 years and be banned from any contact with children under 18 years of age.
