A 14-year-old boy carjacked and sexually assaulted an 87-year-old female at knifepoint while she was returning books to the Waukesha Public Library located in Waukesha, sources have told WRN.

Capt. Dan Baumann did confirm for WRN that the suspect is 14, the victim is 87, and she was sexually assaulted at knifepoint. “This incident is sad and disgusting, but I’m very mindful of the privacy issues surrounding with both victim and suspect,” he said, declining to give further details. We obtained further details from sources.

UPDATE: WRN can now report that the suspect is the nephew of Milwaukee Common Council President and Milwaukee Mayoral candidate Cavalier Johnson.
This afternoon, I learned of an incident that occurred in Waukesha County on November 30 where a member of my extended family is accused of a horrific crime. I am saddened and troubled by this news.

First and foremost, my heartfelt prayers go out to the victim and her family. No one should ever have to deal with what she is going through. I hope and pray for her full healing and recovery.

If what is alleged is found to be true, the accused should absolutely be held accountable for these actions.

No family deserves to endure what this family and this victim are going through, and I am praying for healing and recovery for all concerned.
We asked Waukesha County District Attorney Sue Opper whether she plans to charge the teenager as an adult, as the law allows. She responded, “I cannot comment on this case. Please contact the Juvenile Court for permission to obtain any charging documents or petitions that have been filed.”

Waukesha police have been extremely tight-lipped about the incident, saying the community doesn’t need “more bad news.”

The suspect, who according to sources, recently moved to Waukesha from Milwaukee, WRN has learned. “He has looked up to his uncle who is in politics his whole entire life inspiring to be just like him,” the boy’s mother wrote on Facebook on Dec. 5, trying to raise money through a cash app for his defense. The boy is friends with the mayoral candidate on Facebook.
“My son came into a group of young men who he thought were his friends and talked him into doing something that he should’ve had a mind-frame strong enough to know it was a terrible decision and now the county is declared him a menace to society,” she wrote. (There is no evidence of other suspects, despite the mother’s comments.)

A person who witnessed what happened said the suspect “walked up to the book drop. As soon as she stopped at the book drop, he turned. He was at her car window for about a minute. He made her get into the passenger seat.” He was alone. People had seen him walking around the area for about a week, the source, who did not want to be identified, told WRN.
Sources tell WRN that the suspect took the woman at knifepoint from the book return area of the library on Tuesday Nov. 30, 2021, and forced her back to her car. The suspect drove around while forcing the woman to perform sex acts on him.

We have his name but are not publishing it until he is charged. It is yet to be seen whether he will be charged as an adult; nothing comes up in CCAP under his name.

Per Chap. 938, Wis. Stats. the District Attorney can petition the juvenile court to waive its jurisdiction and have the child tried in adult court if the juvenile is at least 14 years old and is alleged to have committed felony murder, reckless homicide, sexual assault, hostage-taking, kidnapping, armed robbery, aggravated burglary, manufacturing or distribution of a controlled substance, or participation in gang activity.
One of our sources claimed some in the system are worried about “BLM outrage” if the boy, who is black, is charged as an adult. However, we’ve also learned that Waukesha police want him charged as an adult. That decision will ultimately be made by Waukesha County District Attorney Sue Opper’s office.

The Les Paul Middle School resource officer observed the elderly woman in distress in the parking lot and went out to talk with her. The woman was trying to wave down the officer’s empty squad. The school is located at 325 Carroll Street. We first received a tip about the attack from a person who didn’t believe the school was very transparent with parents about what exactly happened.

The suspect was located by police in the victim’s car a short time later and was taken into custody. Sources said police executed a search warrant on the suspect’s home and recovered the victim’s items from the home.

A 14-year-old Waukesha boy accused of sexually assaulting an 87-year-old Waukesha woman last fall may face charges in adult court.

The Waukesha County District Attorney's Office, which on Dec. 2 filed a motion for waiver out of juvenile jurisdiction, is expected to argue at a March 9 hearing that the severity of the crime, coupled with a victim that is considered exceptionally vulnerable, warrant the case being moved to adult court. The boy's defense attorney has opposed such a waiver.
Prosecutors will present their argument for a juvenile court jurisdiction waiver in Waukesha County's juvenile court division, where the youth faces four felony counts: first-degree sexual assault-use of a dangerous weapon, armed robbery with the use of force, kidnapping and operating a motor vehicle without the owner's consent.
According to the juvenile petition:

At one point, the boy tried to sexually assault the woman, she told police. He later demanded whatever money she had on her and a credit card, then allowed her to get out of the car and drove off.
The boy claimed he initially approached the woman's vehicle at the library's drive-through book drop-off to help her put her books into the collection box, but became "enraged." No reason for his anger was included in the petition.

He admitted to taking her credit card, cellphone and SUV, but denied he tried to sexually assault her.
The decision whether to waive the boy into adult court will rest in the hands of Judge Maria Lazar following the March 9 hearing.
 
He committed a very adult crime, so he needs ot be tried as an adult. He hung around the library for a week waiting for a victim he thought he could control then he saw this lady and thought "this is it". I can see a 14yo carjacking and robbing an old lady especially in this day and age, but forcing her to perform sex acts on him is a very sick adult thing to do. He will be a menace to society forever, because the next time he assaults someone, he will, most certainly, kill them.
 
A Waukesha County juvenile court judge has agreed that a 14-year-old boy accused of sexually assaulting and robbing an 87-year-old woman should be tried in adult court.
Judge Maria Lazar presented her oral ruling Thursday in the juvenile division of Waukesha County Circuit Court, ultimately siding with prosecutors, that severity of the allegations and the public's interests outweighed other factors, including the welfare of the youth, Khalil Perry.
The case stems from an incident outside the Waukesha Public Library at about 1:30 p.m. Nov. 30, when Perry allegedly pulled a knife on the woman when she was trying to load books into the book-return machine, commandeered her car with her in the passenger seat and drove to an area nearby, where he sexually assault her.
According to the juvenile petition, the equivalent of an adult court criminal complaint, the woman later told authorities that Perry stated that he was "the devil," knew where she lived and would "come kill her whole family" if she reported the incident.
Perry was arrested a short time later after he dropped her off near the library, drove her car to his home to hide certain evidence, and then drove to an area less than two miles south of the library off Grand Avenue, where he intended to "ditch" the car. There, he was spotted by police and taken into custody after a short foot chase.
Because of his age, the charges against him were filed in juvenile court, with the records sealed as the case was processed. But prosecutors with the Waukesha County District Attorney's Office petitioned the court on Dec. 2 to move the case to adult court.
In the juvenile court waiver hearing on March 9, prosecutors argued that the seriousness of the alleged crimes combined with the potential for relatively light sentences in juvenile court warranted that Perry be tried as an adult.

Under what's known as a "serious juvenile offender" program, Perry, if convicted of sexual assault, would likely face a maximum of five years of supervision, compared to as many as 20 years for the equivalent Class B felony in adult court, Assistant District Attorney Edward Bremberger told Lazar at the March 9 hearing.

But the boy's defense attorney, Nicole Ostrowski, argued that the only compelling argument prosecutors have made about waiving juvenile court jurisdiction is in the seriousness of the crimes.

Other factors should be considered, as well, she said, particularly the kind of specialized treatment he could receive in the serious juvenile offender program, which takes into account studies that detail the workings of immature, developing minds in youths accused in crimes.

Faced with those opposing viewpoints, Lazar, in her oral ruling Thursday noted four points outlined in a state law that were germane to a waiver of juvenile court jurisdiction in the case: the personality of the juvenile, prior record of the offender, the seriousness of the alleged crimes, the adequacy and suitability of facilities and services for juvenile offender's treatment.

Serious juvenile offender program would not offer sufficient treatment, judge says​

But she said she simply couldn't ignore the nature of the charges, which she repeatedly referred to as "heinous."

"The state has in fact met its burden of proof," Lazar said, noting in particular the "extreme vulnerability" of the woman, who told authorities her life had been "shattered" by assault and the threats to her life that included a knife being held to her throat.

Lazar was critical of two pieces of testimony: Waukesha County social worker Kevin Tolzman's opinion that state Department of Correction's serious juvenile offender program would adequately address Perry's treatment, and a report by state psychologist that favored juvenile-oriented treatment options.

Lazar noted that Tolzman's experience with juvenile offenders had never involved anything as serious as the allegations at hand, which diminished his recommendation that suggested that the juvenile treatment program would be effective in this case.

The doctor that performed a court-ordered exam of Perry showed a lack of knowledge about some important elements of serious juvenile offender program and had missed some other information later provided to the court, Lazar said.

Thursday's decision did result in one point of confusion that attorneys are expected to clear up by Friday.

During the March hearing and again in Thursday's oral ruling, Lazar had suggested her word might not be the final one on whether the case remains in adult court. She said she was under the impression that the defense could petition for a reverse waiver back to juvenile court.

But Deputy District Attorney Ted S. Szczupakiewicz, speaking to the court via Zoom at the conclusion of Lazar's ruling, said reverse waivers are only applicable when a case involving a juvenile starts in adult court, not when a juvenile court judge has already waived jurisdiction.

Perry is currently being held in a Washington County juvenile detention facility, but would be transferred to the Waukesha County Jail once criminal charges are filed and bail is set by the adult court.

A Waukesha County jury returned three guilty verdicts in the case against a teenager charged in an attack against an 87-year-old woman at a library in Waukesha.

The jury returned guilty verdicts against Khalil Perry, 15, on charges of armed robbery, armed carjacking and kidnapping while threatening to use a dangerous weapon.
Jurors were deadlocked on a charge of sexual assault. Waukesha County Circuit Judge Jennifer Dorow declared a mistrial for that charge.

The trial centered on the incident from November of 2021 outside the Waukesha Library.

During the four-day trial, prosecutors highlighted surveillance video and evidence found at Perry’s house and in his pockets when he was arrested. He was 14 years old at the time.
The victim testified Wednesday, describing how Perry held the knife to her throat.

"He said, 'I want you to perform a sex act.' I began to pray and talk and say, 'I can't. I don't know what you mean. I don't know how, oh dear God, please save me.'
But, Perry's defense attorney suggested during her closing arguments that the woman embellished what happened to her, fabricating the sexual assault.

"How would that be accomplished without even a bruise?" asked public defender Maura McMahon. "With the gossamer skin of an 88-year-old or an 87-year-old at that time. How does that get accomplished with no injury whatsoever? Make no mistake; I'm not trying to say there was consent. I'm saying this didn't happen."

A Waukesha County judge sentenced Khalil Perry on Friday, June 30 to 12 years prison and another eight years of extended supervision. This follows Perry's conviction on charges of armed robbery, armed carjacking, and kidnapping.

In court the victim spoke only to offer forgiveness.
"All I wanted to say is I forgive you for what you did to me, and the sorrow and pain," the elderly victim said as she spoke directly to Perry.
"Do you have any thoughts on what should happen to Mr. Perry?" asked Judge Jennifer Dorow.

"Justice. I leave this decision to you and trust you will do the right thing," the victim replied.
"I feel like the media has made me look like the worst person ever. I’m not a monster," Perry told the court.

Perry asked the woman for forgiveness.
Again, in total, Judge Dorow sentenced Perry to 12 years in prison. The judge said even though Perry was not convicted of the sexual assault, she believes the kidnapping was sexually motivated. Judge Dorow ordered him to register as a sex offender.
 
this kid is mighty lucky he didn't try to on an old lady like me.... if he demanded a hand job i still have and good strong grip and long hard nails his family jewels would not be the same for a good long while... a blow job i am equipped with good strong choppers and still have a strong jaws :) with a knife at my throat well it is a situation where it is live or die and should i die well good dna somewhere one my body that couldn't be denied :)
