A woman who was upset that her Burger King order took too long got a man to come to the restaurant and shoot one of the employees, according to the Orange County Sheriff’s Office.

Deputies said the shooting happened Saturday around 7:30 p.m. at the Burger King.

When they arrived, deputies said they found Desmond Armond Joshua, 22, suffering from a gunshot wound in the parking lot. He was taken to an area hospital, where he was pronounced dead.

As part of the investigation, video was recovered that showed Joshua in a physical altercation with a male who had him in a headlock, according to the affidavit.

A witness said the restaurant was busy that night and the drive-thru was backed up, which caused customers to have to wait longer than usual.

One woman who was in line was mad about the delay so she got out of her vehicle and began yelling that she was going to have “her man” come to the restaurant, so an employee refunded her $40 and asked her to leave, records show.

The woman waited in the parking lot in her black sedan for a few minutes then drove away and returned with a white truck with a man identified as 37-year-old Kelvis Rodriguez-Tormes, who was demanding that Joshua fight him, deputies said.

A witness intervened to stop the fight when Rodriguez-Tormes put Joshua in a headlock and started choking him, according to the affidavit.

Deputies said after the witness pulled Rodriguez-Tormes off of Joshua, Rodriguez-Tormes then went to his truck and got the gun, telling Joshua, “You got two seconds before I shoot you.”

Shortly thereafter, Rodriguez-Tormes shot Joshua then he fled in the white truck while the black sedan also fled, deputies said.

According to investigators, Joshua had just started working at the Burger King a few days earlier. Officials said he was rushed to a nearby hospital where he died.

Records show both Rodriguez-Tormes and the woman were interviewed after the shooting.

Though their statements are mostly redacted, the report did indicate that Rodriguez-Tormes dismantled the gun used in the shooting and placed it “in a location which cannot be located.”

Rodriguez-Tormes is charged with first-degree murder with a firearm, destruction of evidence and possession of a firearm by a convicted felon.

Potato Head needs to be put down like a rabid badger.
Some tough guy, needing a gun to compensate for a myriad of developmental failure and shortcomings.

Also that hair is the gayest thing ever!
Like Elton John in tights wrestling with Barry Manilow in a powdered wig over a Chapstick kinda gay!

I won't [...] give money to this company.
Quite a few years ago an advertising agency came up with the idea of putting coupons on the back of the register tapes used at Burger King. One of the coupons was for a few dollars or a few percent off a round of clay-pigeon shooting. Burger King refused to issue the coupons, saying, "We don't support that type of thing". The day before they proclaimed that was the last time I ate at Burger King.

I am coming to think that with many people who commit felony crimes, the stupid runs strong in them.

Someone's already a felon, they own a gun they know is illegal, and the use that gun FOR SOMETHING POINTLESS, just wtf.

Although, nobody feels sorry for stupid! :D Feel sorry for like genuinely retarded yes, but not stupid, and especially not violent stupid.

This story reminded me of the Chappelles Show sketch ‘When Keeping it Real Goes Wrong’, wherein a person who is mildly inconvenienced has the opportunity to either move on with their life or “keep it real” which always escalates and ends with them in jail. This is literally that.

A Dave Chappelle reference is always relevant!

Poor hard-working Mr. Joshua. Such a waste. Condolences to his family.

A Florida woman was arrested in connection with the death of a young Burger King employee, days after her husband was also nabbed for shooting the worker in the restaurant parking lot following a fight over the drive-through delay, police said.

Ashley Mason, 31, was charged on Wednesday for her involvement in the death of Desmond Joshua, who had recently started working at a Burger King in Orlando.

The Aug. 1 shooting followed an argument involving the Burger King’s manager, Joshua and a woman, whom police officials later identified as Mason. Police said Mason had allegedly grown irate over the long wait time at the fast-food restaurant’s drive-thru, where she ordered $33.11 worth of food.

Ashley Mason, 31, was arrested Wednesday in connection with the Saturday killing of a 22-year-old Burger King employee, according to the Orange County Sheriff’s Office. (OSCO)

She was refunded her money and was ordered to leave, but not before she “threatened to bring her ‘man’ to the restaurant,” the affidavit states.

According to an affidavit, subsequent video footage showed that Mason left the Burger King parking lot and shortly after with her husband, Kelvis Rodríguez Tormes.

Rodríguez Tormes allegedly “demanded to fight” with Joshua and the pair moved to the parking lot, where he “placed [Joshua] into a headlock and began to choke him,” the affidavit states.

As the men were fighting, Rodríguez Tormes allegedly said: “Bust him if he touches me,” according to a description of cellphone footage from the document. Witnesses broke up the fight.

Rodríguez Tormes then climbed into his truck, at which time, he told police, he saw the younger man “jump over his wife’s black Honda Accord and walk toward his closed driver’s door, which still had the window up,” according to the affidavit.

He opened his window and stated: “You got two seconds before I shoot you,” the affidavit states.

Moments later, he shot Joshua a single time in the chest and drove away. The 22-year-old was rushed to a local hospital, but could not be saved.

According to the affidavit, witnesses told investigators they also watched Mason take her husband’s gun and point it at restaurant employees before handing it off to Rodríguez Tormes.

When she got into her car, she allegedly had attempted to hit Joshua.

Mason was charged Wednesday with principal of first-degree murder and aggravated assault with a firearm.
