According to a Grant County Sheriff's Office news release, there was a warrant out for Daly, who was charged with kidnapping.
When GCSO deputies arrived on Airstrip Road in Mimbres on Tuesday, Dec. 23, they saw Daly carrying her child into an RV. After some effort, deputies spoke to Daly on the phone, but she refused to come out. A New Mexico State Police SWAT team came to assist the deputies because there was reason to think Daly had a handgun. A gunshot was heard and the deputies went inside the RV, where they saw Daly had the handgun pointed at her head.
They also saw that her son had been shot, and despite life-saving measures, the child died before he could be flown to a hospital, the release said.
Daly was arrested on the kidnapping warrant from Wyoming and also charged with an open count of murder in the first degree, a capital offense, and child abuse resulting in death, a first-degree felony.
