According to a criminal complaint, Randall Pablo, 36, had been watching his 4-year-old nephew, who is referred to as "John Doe" in court documents, at his family's residence, while the child's mother was taking her 1-year-old daughter to the clinic.
Pablo allegedly told the mother of the child that he had been jumped, and his nephew had been killed.
When the mother arrived back at the residence, she saw multiple disheveled items thrown around the house and Pablo lying on the floor next to the 4-year-old child.
The mother says she was then instructed by police to drive to the gas station and perform CPR on the child because he was cold and did not have a pulse.
When police arrived at the scene of the gas station, they noted that the child had bruising on both sides of his head and face. He was pronounced deceased at the scene.
Navajo Police arrived to the Herera's home where they found Pablo lying in a pool of blood and bleeding from lacerations on his left arm. He was transported to UNMH for his injuries.
Pablo told an agent at the hospital that he was with his nephew at the residence when he noticed he looked sick. Pablo said he went to the restroom and when he returned, his nephew was unresponsive.
Documents state that Pablo's mother and father have a restraining order against Pablo from a previous incident of assault, harassment, and property damage. Preliminary findings suggest Pablo's nephew suffered significant blunt force trauma to his head.
Pablo is facing charges of abandonment and abuse of a child under 12 years of age, resulting in death, intentionally caused in Indian Country.
