NEW YORK -- The Brooklyn DA has just announced the indictments of Nymeen Cheatham, 31 and Lemar Martin, 25 for killing three-year-old Kyle Smith, who had been living with them, in their care.
Cheatham and Martin are both charged with Manslaughter in the First Degree, Manslaughter in the Second Degree, Criminally Negligent Homicide, Assault in the Second Degree and Endangering the Welfare of a Child. If convicted, they face could face 25 years in prison.
Police found Kyle Smith's battered body Friday in the apartment he shared with his guardian and her boyfriend.
Around 10:30 a.m., police went to the fourth-floor apartment at 129 Patchen Avenue in Bed-Stuy. Paramedics took the unresponsive child to Interfaith Hospital, where he was pronounced dead.
The medical examiner ruled Smith had been beaten to death. Police said the 28-pound boy had a broken leg and appeared to have been burned and sodomized with an object before he died.
"The kid was really messed up," neighbor Greg Daniels, 22, told the Daily News. "He was pale, and there were cigarette burns and bruises on his arms and back."
If convicted, they face could face 25 years in prison.
A superintendent in the building, Gail McNally, told reporters the boy had arrived at the home about a year and a half ago, and was in Cheatham's care because his mother was a drug addict.
She said the boy appeared malnourished when he first came to the family, but had improved and had previously shown no outward signs of serious physical abuse.
"It broke my heart to see them pumping his chest and breathing for him on a respirator," McNally said. "I was hoping to God he had a chance."
Neighbors called Cheatham the boy's godmother, but a police spokesman said that description was incorrect.
 
"My client has a lot of stress," Cheatham's attorney Joseph Miller said. "She loved that child."

A Brooklyn woman said Tuesday she "just snapped" and blindly beat to death a 3-year-old with a brush because he wouldn't go to sleep.

Nymeen Cheatham avoided a possible life sentence by pleading guilty to manslaughter in the June 6, 2007, death of Kyle Smith, who was in her care.

The boy's father, grandmother and aunt listened incredulously as Cheatham tried to portray her brutality as a moment of insanity.

"I lost it," she said in Brooklyn Supreme Court.

"I started to spank him and it was dark and I didn't see exactly where I was hitting him or how I was hitting him.

"It was dark and I was just spanking him and I got a brush and I started to spank him again. He finally quieted down."

The boy was declared dead the next day after Cheatham called for help.

Prosecutors alleged Kyle was sodomized, doused with cold water and forced to do pushups. Bruises and cuts were testament to a horribly slow and painful death, his family said.

"I definitely wanted to hear her admit she did it, even though it was not all the truth," said Kyle's father, Elliot Smith, who believes Cheatham was trying to cover for her boyfriend, Lemar Martin.

"How do you do something like that just one time and cause those horrible injuries?" asked Kyle's grandmother, Norma Acosta.

Cheatham, 32, faces 20 years when she's sentenced in January. Martin still faces a murder trial and plans to call Cheatham as a witness.

Yes, apparently she loved him to death. She said she beat him because he would not go to sleep. She said beat him "until he finally quieted down". And aftersaying this she get 20 years? I just don't understand this. I think that killing a child should be a capitol crime with limited appeals and mandatory death. This might not save many lives but it sure would be justice for these innocent children.
 
I've said it before, we need minimum mandatory sentences. Its crazy, people consistently get more time for drug offenses than child abuse due to the min/man sentence laws for trafficking.

only way to get it is to get involved in putting laws on the books. I've always thought this site would be a good hub for that sort of activity...
 
A local mother who admits she “snapped” and beat her friend’s 3-year-old son to death has been sentenced to 20 years in prison.

Nymeen Cheatham pleaded guilty to manslaughter in Brooklyn Supreme Court in November. Wednesday, Justice Gustin L. Reichbach sentenced the 32-year-old Bedford Stuyvesant woman to the maximum term of 20 years.

Cheatham said she hit Kyle Smith with a brush in June 2008 because he wasn’t going to sleep. Cheatham’s boyfriend Lemar Martin still faces a murder trial.

Court papers said the little boy was also sodomized, doused with cold water, and forced to do push-ups and march in place as punishment. They said his injuries included a torn tongue, bruises and internal cuts.

Authorities said his mother, a drug abuser, had left him in Cheatham’s care.

Martin and Cheatham were living with Smith when he died from the abuse on June 6, 2008, in a death that drew comparisons to that of abused 7-year-old Nixzmary Brown, who was killed by her mother and stepfather, also in Bed-Stuy.

With Smith’s father’s consent, Smith was reportedly left under Cheatham’s care by his crack-addicted mother, Eugenia Holmes. Cheatham, however, already had her own children taken away from her by social services after allegations of abuse were made when Cheatham lived in Texas.

I have no doubt that family feel guilty and often think of the "only if's", all the time. The grandmother took in Darien, Klye's brother but had no room for Kyle. I got to tell you, I would have slept on the floor to take in both. Kyle's mother ultimately made the decision to leave Kyle with the two fuckers we read on. Her intention was all good trying to get help with her drug problem BUT even then, how could she leave him with someone with an active warrant out for them. ONE look at these fucktards and no way, no how, you leave a helpless child with them.

The lack of care she put into this decision stole away Kyle's little life. But then a woman on drugs probably would use real poor judgment. These vile creatures should never see the light of day again. I'm going to trust that in prison, as people learn what they are they will see their end come fast and painful.

Simple rule of thumb. Treat your children like they are the most precious gift of all, that being away from them would make it hard to breath.

You were the light of life little Kyle, you deserved to be protected and cherished.

A city housing guard who claimed he was a 3-year-old boy's "guardian angel" was convicted of murder Wednesday for doing nothing as his girlfriend beat the child to death.

Lemar Martin, 27, now faces a life sentence and will serve more time than his girlfriend, Nymeen Cheatham, who pleaded guilty in exchange for a 20-year sentence.

But jurors, who saw gruesome pictures of Kyle's body almost completely covered in black and blue, didn't believe anyone could sleep through such a horror.

"It was hard to even look at those pictures," said one woman. "We were very sure. Justice was done."
