The perpetrator was his St. Luke’s physical therapist, Arnee Rubia a 43-year-old married father of two with no criminal record.
Rubi will serve six to 23 months in Northampton County Jail after pleading guilty in September to indecent assault, Senior Judge Leonard Zito ordered. Rubi will also spend two years on probation and for 25 years, Rubi will be required to register as a sex offender.
Authorities said Rubi molested his victim during physical therapy at the man’s home in Hanover Township, where he was being treated for a hip injury.
Rubi was caught May 21 when the victim’s granddaughter returned to the house and surprised Rubi, who was standing over her grandfather and abusing him.
According to the arrest affidavit, Rubi adjusted his pants and left. But the next day, police interviewed the victim, who related that on two occasions, Rubi had touched him inappropriately and also forced him to touch Rubi.
Assistant District Attorney Laura Majewski said Rubi preyed upon an especially vulnerable man and used a position of authority and trust to do so. She charged that Rubi minimized his crime and tried to blame his victim.
His lawyer, James Heidecker, said Rubi lost everything, including his profession.
Heidecker said Rubi sought psychological help after his arrest, to try to shed light on what happened.
Rubi expressed regret, saying he brought pain and embarrassment to a lot of people. “I will do everything I can to become a better person and not allow this to happen again,” Rubi told Zito.
