Muslim Teen Involved In Vicious Assault Granted Bail After He's Attacked In Jail

A teenager from Afghanistan charged over the 'vicious and unprovoked' group bashing of an American surgeon and his son during the Australian Open tennis has been given bail.

The 17-year-old boy, who cannot be named because of his age, is one of five teens charged over the late night assault of Dr Edmund Pribitkin and son Edik near Melbourne's Queen Victoria Gardens on January 17.

The teenager, who moved to Australia from Afghanistan four years ago, was granted bail with strict conditions, including a curfew, after his Department of Justice case manager said he had been targeted in custody because he was Muslim.

The youth faces additional charges of affray and unlawful assault over a separate February 2 incident at the Melbourne Youth Justice Centre.

'Someone's come up and delivered a fairly good blow at him and then it's alleged he's hit ... back,' his lawyer told the Children's Court of Victoria on Wednesday.

He also said his client was attacked and hospitalised in a separate incident days later, and had been thinking about suicide and tried to self-harm.

In granting bail, the magistrate labelled the alleged attack on Dr Pribitkin and his son as 'vicious and unprovoked', with the surgeon suffering 'horrific life-changing injuries'.

The surgeon was punched and kicked to the ground and his belongings were stolen after a group of youths asked for cigarettes, police have said previously.

His son tried to give the group his wallet and phone but was also attacked.

In hospital, Dr Pribitkin had to be placed in an induced coma and have titanium plates inserted into his face.

The magistrate said the case against the 17-year-old was weaker than that faced by his co-accused.

'Even at its highest it is a weak crown case,' she said.

The boy came to Australia from Afghanistan with his mother and siblings about four years ago, the court was told.

He stopped going to school in 2016, could not tell the time and had the reading abilities of a prep or year one student.

His bail conditions include living with his mother, a curfew, engaging in a youth justice program and not associating with three of his co-accused who are also on bail.

'This is not a decision reached lightly and the court will readily revoke bail if there is a breach of any conditions,' the magistrate said.

I remember watching the news report about this. They said that the police were looking for suspects but never gave any type of description, even though it was plainly obvious that the victims got a great look at the perpetrators. So naturally I thought that it was the Sudos or the Somalis again, guess I was wrong. There's a first time for everything. Why did we allow them here in the first place? Deport this asshole and his whole family, I hear Afghanistan is lovely this time of year.

These are the seeds being sown by military action all over the globe by many state actors, although some stir the shit more than others. One cannot expect children raised amidst war to be on a level with our children, and if we're going to accept them into our countries then we need to provide mental health care, medical care, and educational help. No doubt many are also living in public housing and criminal environments. People bitch about providing social services to refugees, but it's obviously necessary for our own protection. We already know this, because we have our own disenfranchised citizens going on the attack daily against the majority of law-abiding citizens.

That said, I don't agree with releasing him even with the conditions. The system may need to rethink the handling of this type of youthful offenders.

I don't think we should expect less of them, but I do think we should anticipate they're fucked in the head and may need some sort of rehabilitation and cultural re-education. Of course, it should start as soon as they arrive. Probably too late for this particular young man. Perhaps, that sort of intervention is considered racist or politically incorrect, but it needs to happen.

Instead of releasing this young man, even with the limitations, they could have just as easily
put him in "protective custody" single man cell - solitary. The US jails do this daily.

Why is he not being deported or put in a cage based on this fact alone? He IS a caveman, just like the culture he came from in Afghanistan.
