John Paul Sayama Charfauros, 27, was arrested by Guam Police Department officers on July 31, along with the child's mother, Jonarie Marie Reyes Cruz, on multiple felony charges.
Charfauros faces charges of murder, aggravated assault and a special allegation for use of a deadly weapon in commission of a felony, for each charge.
The mother was charged with child abuse, destroying evidence and tampering with a witness.
According to the charging documents, at a family pool party held July 4, Charfauros decided to teach the three-year-old boy, T.C., how to swim. He allegedly told police that he "went a bit far as far as teaching him to swim and horse play" but denied hurting the boy.
Police reviewed 90 minutes of video footage that allegedly showed Charfauros dunking the boy's head underwater, and also striking him multiple times.
The complaint states that Jonarie Cruz brought her son to the hospital and allegedly told staff there that her son slipped and fell in the water for over a minute. She also asked others to lie on her behalf.
