State Police have issued an Amber Alert for 9 year old Gustavo Oliveira.

State Police say he was last seen at around 1:00 AM on Tallow Wood Drive in Clifton Park.

Gustavo Oliveira is a Hispanic male, approximately 9 years old with short, black hair and brown eyes. He is approximately 4 feet 8 inches tall and weighs about 100 pounds.

Police say the man they are looking for is Nivaldo P. Oliveira, a Hispanic male, approximately 41 years old with short, black hair and brown eyes. He is approximately 6 feet 0 inches tall and weighs about 190 pounds.

State Police confirm that Nivaldo was arrested on charges of 2nd degree burglary along with 4th degree stalking in February of this year. State Police say they responded to a residence in Halfmoon for a domestic dispute. Oliveira was accused of entering the victim’s residence without permission and remaining in the home. While inside, he disconnected the victim’s surveillance cameras.

Police say Oliveira left the scene prior to the arrival of patrols., but was taken into custody when he returned to the victim’s home on February 12th.

The child was taken under circumstances that lead police to believe that they are in imminent danger of serious bodily harm and/or death, according to Police.

Nivaldo Oliveira was sentenced to five years in prison and five years of postrelease supervision on August 1, 2022, after pleading guilty to one count of second-degree burglary. [1, 2]
While originally charged with 20 counts, including second-degree kidnapping and endangering the welfare of a child, the other charges were dropped as part of a plea agreement. [1, 2]
