Wilmington, NC Police Department

A wanted man was arrested last night by Wilmington Police for indecent liberties with a minor. Malik Matthews (age 25 from Wilmington) had multiple warrants out for him including lewd and lascivious, statutory sex offense against a child less than 13 years old, and indecent liberties with a child. He was taken into custody by officers without incident and is in the NHCSO detention center under a $500,000 bond.

How is it statutory with a child too young to give consent?
"Statutory" just means according to the law. In other words, the minor may well have thought they wanted to have sex with the suspect and may have demonstrated their consent to sex with the suspect, but the law says they cannot yet give a valid consent. This is distinct from forcible sex offenses, where consent is not freely and voluntarily given.

So, if a 25yo hears consent from a person under 13 (0 through 12) then it's a no-no?

I'm thinking that statutory means 'stand real still - like a statue - and maybe I won't hit anything with this hatchet I'm gonna throw between your legs.
