Man Accused Of Dismembering Woman, Dumping Remains

"Ethan Broad, 27, was charged Monday in Clay County court with second-degree murder without intent while committing a felony. Bail was set at $1 million, without conditions, and Broad remained in jail Monday.

According to the complaint, Broad killed Dystynee Avery, cut up her body with a saw, put the remains into garbage bags and dumped them near his apartment in south Moorhead, on the border with North Dakota.

Broad initially told investigators that someone else had hit Avery over the head with a lead pipe and cut her throat, but later admitted that he killed and dismembered the young woman. He called it an act of self-defense.

The complaint does not say when the killing took place. Avery was last seen in Moorhead on April 3 and friends reported her missing April 5. Avery's worried mother reached out to police April 9 to say she hadn't heard from her daughter.

Broad was arrested on Friday.

The complaint does not explain the relationship between the two. Broad told police that Avery had lived with him for a short time but that she had recently removed her belongings from his home.

According to the complaint, police found a bloodied saw with what appeared to be human tissue inside Broad's garage. A blue bin in the garage had “a large amount of blood inside,” according to the complaint, and surveillance video showed Broad dragging a blue tote from the apartment building to the garage area, police said.

Several spots in Broad's apartment appeared to be cleaned-up blood, the complaint said. Broad said he cleaned the apartment with bleach but that several bloodstains turned pink on the carpet."

Authorities allege that Ethan Broad murdered his friend Dystynee Avery before dismembering her body and tossing her remains in dumpsters.

Minnesota man thought to be a missing teen girl’s good friend has now been charged with her presumed murder.

Dystynee Avery, 19, was last seen in south Moorhead on Apr. 3, the Moorhead Police Department stated Saturday. That day, both Avery’s mother Doreen Avery and her boyfriend Jordan Yarborough said they received calls from the teenager's friend Ethan Broad, 27, according to KVLY.

In those calls, Broad allegedly claimed that he and Dystynee — who was staying with him temporarily — had a fight the night before. He allegedly said she vanished afterward.

“A bunch of B.S. because obviously he had already taken her life. She was already gone," Doreen speculated to KVLY.

Following Dystynee’s disappearance, police tried to locate her. Soon they conducted searches of Broad's apartment and garage and the missing person investigation soon turned into a murder investigation.

“The investigation led to the belief that foul play was involved,” police stated Saturday.

Broad was arrested and charged with second-degree murder. Following his arrest, he allegedly told police that he killed and dismembered Dystynee in his garage before bagging her remains and tossing her body parts into dumpsters at the apartment, Minnesota's Star Tribune reports. He initially denied killing her, but then allegedly claimed he killed her in self-defense, the outlet reported.

A bloodied saw with human tissue was allegedly found inside Broad's garage along with a bin with "a large amount of blood inside," according to a complaint obtained by the Star Tribune. The complaint also states that blood stains were found in Broad's apartment.

Dystynee's remains have yet to be found.

Doreen told KVLY that her daughter had stayed with Broad in the past. She said she thought he was a good friend to her.

Doreen said her daughter always called her to say "Mom, I love you." Yarborough also described Dystynee as loving.

“Dystynee was kind-hearted and caring for everyone she met. She would always try her best to keep you happy no matter the situation,” Yarborough told Oxygen.com. “She would talk with you and spend time with you during your situation. If you need someone to talk to or needed something she would do her best to get it.”

He added that she was a “wonderful person” who just enjoyed making others happy.

“If you needed someone, she would be there in a heartbeat. Just everything she did and said always kept me happy,” he said.

It’s unclear if Broad has an attorney who can speak on his behalf at this time. His bond has been set at $1 million and he is expected in court on May 14.

27-year-old Ethan Broad pled guilty to second-degree intentional murder for the killing of Dystynee Avery. Broad admitted to stabbing Avery in the throat with a knife, hitting her over the head with a pipe and bringing her body to his garage. Court documents say in the garage, Broad then dismembered her body and threw it in the trash. Avery’s body was recovered from the Clay County Landfill in late April after a two-day search.

“Do I think he should spend the rest of his life in jail? Absolutely. But I feel like Dystynee got justice today because he actually admitted what he did to her,” Doreen Avery, Dystynee’s mom said Friday afternoon. “He basically took my world away from me. He turned my world upside down.”

Listening to her daughter’s killer recount the gruesome details of April 3 was difficult for Doreen, but she says she’s glad Broad is finally taking responsibility.

“I definitely feel like Dystynee got justice today. I will keep getting justice for my daughter until all four of them are sitting in jail, I will keep doing what I have to do to get justice for my daughter,” she said.

“He can sit there and he can fake those tears, but I’m not stupid. He has no remorse for what he did,” Doreen said.

Broad stated Dystynee’s death was due to an argument between the two where he lashed out in rage after he says Dystynee was waving a pipe in his face. Doreen says she doesn’t believe that claim for a minute.

“I felt like it was all a show, like it was all trying to be like, ‘Oh, poor Ethan,’” she said.

Broad won’t be sentenced until next month, and Doreen says she plans to address him.

“Now all I have is pictures and videos. That’s all I have left of my daughter. I will never see her smile, her laugh,” she said.

Doreen says she hopes the other three accused of helping cover up Dystynee’s murder, Andrea Payne, David Erno and Brandon Erbstoesser, will also avoid trial. She hopes they will take a plea deal soon as the longer this drags out, the more it taints the way she remembers Dystynee.

“I don’t want to think about Dystynee like that anymore. When I remember her, I want to remember the person that she was! The bubbly, happy and excited person that she was,” Doreen said.
