Jordan Payne, 31, has been indicted by a federal grand jury on murder charges in the death of his then-girlfriend’s infant daughter.
Sources close to the investigation say in October of last year, Payne killed Rachel Foreman. Court records say she died from blunt force trauma to the head. The indictment also says Payne willfully and maliciously failed to provide medical care for the child.
 
The federal trial of a Grove man charged with killing an infant is going into its fifth day.

Jordan Payne, 31, is charged with second-degree murder and child neglect in Indian Country in the death of Rachel Tymprance-Jane Simpson.
The infant died Oct. 19, 2024, just a week before her first birthday, from blunt force trauma to the head, according to an autopsy.
Both sides of the child’s head were so severely bruised that blood collected outside her brain, both retinas were bleeding, and she suffered stroke-like brain activity, according to the autopsy. There were two fractures to the child’s eye area and several “distal fractures” to her head, and she had a broken tibia and fibula just above the ankle, according to the autopsy report and court records.
The autopsy report showed the child had seven contusions and abrasions to her head, six contusions and bruises to her arms and legs, and her left shin and calf bone were fractured.

There was also a “potential 4th rib fracture,” the autopsy reported.
Melissa Foreman, the infant’s mother, met Payne through a social media dating app and occasionally stayed at Payne’s house in Grove. Foreman knew that Payne worked overnight, and “she acknowledged that Payne could be short-tempered when he was sleep deprived,” the court document states.

Payne told Foreman that he wanted to spend time with the baby and said he would watch her while Melissa was at work.
Court records show Foreman left for work on Oct. 15 at approximately 11 AM and the child was healthy and unharmed.

During the 45 minute drive to Foreman’s work, Payne called saying the child was crying and would not stop. Foreman explained to Payne how to sooth the child. Payne sent Foreman a photograph of the child lying on the floor near what resembled vomit.
Payne messaged Forman the child had slept most of the day.

Foreman returned to Payne’s house at around 6:45 P.M. When she went to pick up the infant she noticed that she was “limp, cold, and unresponsive” and she “labored to breathe.”
The child was taken to Intergris Grove General Hospital and later St. Francis. During her four-day stay in the pediatric intensive care unit, she “displayed evidence of neurologic devastation” and was declared dead.
In an unrelated matter, Foreman, was scheduled to appear on the day of her testimony in Cherokee Nation Criminal Court on felony counts of child sexual abuse and contributing to the delinquency of a minor. She is accused of giving a controlled dangerous substance to a 13-year-old boy and sexually abusing him, according to court records.

Rachel deserved so much better.
