Guilty But Insane: Keizer Woman Re-Charged With Murdering Son After Last Case Dropped Due To Mental Illness

A 46-year-old Coquille woman has been charged with the 2017 death of her 12-year-old son and the torture of another child, according to court documents.

Marion County Circuit Court records show that Amy Marie Robertson was charged with first-degree and second-degree murder for the strangulation death of Caden Berry, as well as two counts of first-degree criminal mistreatment for the abuse and torture of another child. The child was abused between March 2015 and March 2016 and the crimes occurred in Keizer, according to court documents.

Court records show that Robertson was initially charged in 2017 but those charges were dropped in 2020 while the woman was committed for mental illness at the Oregon State Hospital.

A neighbor, Brenda King, 65, told the Statesman Journal she found Caden under a blanket in his mother’s apartment, two doors down from her own. She went in after Caden’s mother was outside waving her arms and causing a commotion.

“When I couldn’t wake him up and I pulled the blanket back, it didn’t even look like him. I had to take a double-take, ‘cause his face was swollen,” King said.

Caden, a seventh grader at Claggett Creek Middle School, was described a shy but happy boy who loved Pokemon, video games, and football. He was the youngest of Robertson's three sons.

Another of Roberton's sons, Colby, committed suicide Nov. 14, 2011. He was 12 years old. The Oregonian reported that Robertson's other son, now 14, lived with her until May 2015, when his father got custody of him. Coos Bay police assisted the Oregon Department of Human Services in May in an incident involving Robertson, a police report shows.

Are they absolutely sure the other son died from suicide?
I mean it's definitely possible, given the circumstances, but it also seems possible that she killed him as well. Especially if the suicide was hanging or strangulation based, like this murder.
I hope both boys are at peace now and their living brother is able to live a full and happy life. It must be horribly difficult having lost two brothers like this at such a young age.

A Marion County Circuit Court judge has found a Keizer woman guilty but insane eight years after she strangled to death her 12-year-old son.

Amy M. Robertson, 46, could spend the rest of her life under the watch of Oregon’s Psychiatric Security Review Board.

Judge Lindsay Partridge found Robertson guilty except for insanity for the first- and second-degree murder of her son, Caden D. Berry, in 2017. That finding means Robertson could not comprehend her actions at the time because she was mentally ill.

She also pleaded guilty to two counts of first-degree criminal mistreatment for injuring her other son. Salem Reporter does not identify survivors of child abuse.

Partridge committed Robertson to the state board’s jurisdiction for up to the rest of her life. The judge found that Robertson was a “substantial danger” to others and ordered that she be placed at the Oregon State Hospital.


People found guilty but insane can be institutionalized at the state hospital or released to the community under certain conditions, “at levels of care ranging from secure residential treatment facilities to independent living,” according to the board’s website. They can also be discharged altogether if their mental state changes and they are no longer a danger to others.
