An Omaha mother accused of child abuse resulting in the death of her 5-month-old is in court Tuesday.


Thursday, March 15th Omaha police responded to a call of an unresponsive 5-month-old infant, Justice Layton.

When police arrived at the home parents John Layton and Ashley Newburn say the family of four was sleeping in the living room of the house.

They told police that Ashley woke up to find Justice limp and unresponsive.

The child was transported to a local hospital with CPR in progress. Doctors advised that the infant's injuries indicated abuse. The child later died due to injuries.

Detectives interviewed parents, during interviews the child's mother admitted she observed the 5-month-old not breathing due to the color of her lips, she also said the infant was limp and unresponsive.

The mother said she was alone with the child when the fatal injury occurred but refused to provide details of the act that caused the injuries.

The mother was arrested for felony child abuse.

Ashley's father and mother believe Ashley is innocent and are shocked at the accusations.

"I've never seen her violent towards anybody, she used to babysit for people. She love kids, I just can't see my daughter doing this," said Charles Newburn.

"The doctors say 'this is it, I can't explain it' and so we're going to go with this. It happens where doctors can miss things. If they can't explain it they'll just give whatever answer they want to give." said Ashley's mother.

The 6-year-old daughter of the couple, Alexxa, disclosed to police domestic violence between her mother and father. Police believe Alexxa is in danger and paperwork has been filed to take custody of her.

Being a babysitter is so not the same as being a mother. A baby sitter gets to go home and relax after work, a mother does not. All it takes is bouncing the baby off one wall in anger because you haven't slept in a week.
 
She has broad shoulders,
yet they couldn't take the load of child rearing.

Her folks need to pull their heads out of their asses as @Ripley has said.

Douglas County prosecutors have dropped a charge against an Omaha woman once accused of child abuse resulting in the death of her 5-month-old daughter.

In April, Ashley Newburn, 28, faced a felony for the death of Justice Layton.

At the time, prosecutors and police alleged the 5-month-old girl died from injuries consistent with shaking or jarring motions.

The Douglas County Attorney's office says the charge was filed based on reports from a specialist, and an autopsy report later produced evidence that did not corroborate the specialist's findings.

Newburn's defense attorney, Natalie Andrews, told the judge she did not believe enough evidence was presented to show that Newburn harmed her daughter. Andrews pointed out that there were two other adults in the apartment- Newburn's boyfriend and another woman.

Two people were found dead in a North Omaha home and a third person was taken to a hospital in critical condition Monday night after police responded to a 911 call about an apparent drug overdose.
Officers were called to a home near 30th Street and Larimore Avenue about 6:30 p.m., according to an Omaha police spokesman. Omaha Fire Department medical personnel found a woman down in the living room and administered Narcan to revive her. She then was taken to the Nebraska Medical Center.
A search of the house located John Layton, 35, and Ashley Newburn, 32, dead in the basement.

So both of the parent dead from an overdose.
 
Ashley’s parents were shocked. “We never ever saw her do drugs. She would just say NO if anyone offered them to her. We think that medical examiner is just saying that for fun.”
“We believe she died from SADS, sudden adult death syndrome. Please contribute to our Go Fund Me so we can clear our pumpkin’s good name.”
