At 5:37 p.m. on Saturday, police were called to the La Quinta Inn by someone who said they learned secondhand a child may be unconscious and not breathing in a bathtub, according to a Bakersfield Police Department release.

Officers found the room and knocked. No one answered, and they forced their way inside.

The girl was found dead in the bathtub with “substantial trauma”. No one else was there.

Police said the investigation led them to 31-year-old Ray Mata Jr., and 27-year-old Graciela Bustamonte. They were arrested Sunday morning on suspicion of murder, torture and multiple counts of child abuse.

According to the report, authorities wrote in the affidavit that Mata and Bustamonte had spent two days "working in tandem" to repeatedly torture Genesis in numerous ways, including pouring hot water directly onto her skin, resulting in severe burns.

They couple also allegedly smashed the victim's hands so badly that her fingernails came off.

Police reportedly said Mata ultimately admitted that he punched Genesis in the stomach, which led directly to her losing consciousness and dying. Bustamonte allegedly admitted to taking part in multiple torturous acts that led to her stepdaughter's death.

Genesis' cousin, Sabrina Guerrero, attended the proceedings where she told local ABC affiliate KERO that multiple family members had reported Mata and Bustamonte to Child Protective Services, saying there were "big time" signs the child was being abused and that "the system failed" her little cousin.

The couple face additional counts of torture and cruelty for abuse against an 11-year-old boy — his first initial J. and last name Mata.

That 11-year-old boy’s abuse included bruising all over his body, scarring to his back consistent with being hit over a long period of time, cigarette burns, and scarring from a lighter leaving a U-shaped burn.

The police reports say there was skin splitting and massive blistering on Genesis Mata‘s body. Her back had massive scarring, consistent with being whipped. Genesis was missing her fingernails.

Bustamonte told police that the children would be whipped horribly with wires and hangers.

Both Mata and Bustamonte at first minimized their involvement and blamed the other for the gruesome injuries. Eventually, however, both admitted to abusing the children. Both saying Genesis died on the night of Aug. 1.

Bustamonte goes on to say that she watched as Mata killed Genesis, hitting her in the abdomen and watching her fall unconscious. She did not call 911 or seek medical attention for her 8-year-old stepdaughter, neither did Ray Mata.

Bustamonte stated that she told Mata to pour boiling water on Genesis. After, they told Genesis to put another cup in the microwave to boil more.

Bustamonte also said they put Genesis’ hands in a door frame while Mata held her hand. Bustamonte slammed the door shut, causing Genesis to lose her fingernails.

This horrific and tragic abuse because Genesis wouldn’t “listen,” according to Bustamonte.

“Ray Mata stated he did not mean to do this, and it happened out of madness,” an investigator wrote. “Ray Mata stated it happened because his kids weren’t listening.”

There are still multiple unanswered questions we are seeking answers to:

• What is the status of the other seven children removed by CPS?
• Why didn’t CPS take action right away. after abuse was reported?
• Who is Genesis’ biological mother?
• Why wasn’t Genesis with her biological mother?
• Did she and Mata share custody of Genesis?
• How many kids lived at the motel?

Graciela Bustamonte, accused of torturing and killing 8-year-old Genesis Mata, was attacked inside Lerdo Jail on August 8, according to the Kern County Sheriff's Office.

The inmate accused of the assault, Anita Doron, spoke with Eyewitness News, expressing no remorse for her actions and stating she would do it again.

"When you're faced with someone that's gross and has no remorse, you kind of don't want to deal with it because you don't want to take it to where you want to take it to," Doron said. "I would definitely do this again."

Doron, who has pleaded no contest to reckless evading a peace officer and taking a vehicle without the owner's consent, said the case felt personal to her.

She revealed that she and other inmates were aware of the abuse Genesis Mata suffered and avoided Bustamonte.

"There was another woman that she was talking to about her case, but I mean, no one really wanted to deal with her," Doron said. "Some of the girls had seen her not taking it too seriously. She had come back from court, and she was laughing and giggling and stuff, and they were just like, Why, what's funny?"

Doron, who has a cousin named Genesis around the same age as Mata, said her own experiences in the foster care system influenced her actions.

"When it comes to the foster system and the CPS system, just, we gotta get these kids. It's really serious what's going on with these children," Doron said. "This is really an epidemic that's going on with kids, and it's disgusting, but something needs to be done."

Following the assault report, Doron's commissary account was maxed out by community donations, though it's unclear if this is related to the assault.


Doron expressed surprise at the support, saying, "I just heard about that. So I'm surprised, thank you. I'm very surprised."

Bustamonte was hospitalized after the attack but has since returned to Lerdo Jail.
