A one-year-old was allegedly beaten to death by his mother and her boyfriend after the boy's father made frantic calls to child protection services months before begging them to protect his son.
Jayden Noel died on January 18 after repeated blunt force trauma to the head, according to the county coroner, who ruled his death a homicide.
His mother Chelsea Taylor, 20, and 29-year-old Ryan Worline were charged with neglect of a dependent resulting in death after being arrested on Monday in Shelbyville, Indiana.
On January 18, the couple called police to say they had woken up to find Jayden not breathing. He was pronounced dead at the scene.

The boy's father Jerraco Noel, 23, from Shelbyville, had noticed a large bruise on his son's face when he visited him last August, according to the Indystar.com.
Mr Noel claimed to have contacted the State Department of Child Services to tell them that he believed his son was being abused.
He reportedly appealed to the agency to protect the boy because he had limited contact due to an ongoing custody battle with Taylor.
Mr Noel told the Star told the Star that his own father had died when he was three years old and added: 'All I ever really wanted was a father-son relationship.'
On April 9, Worline was arrested at a residence in Indianapolis while Taylor was apprehended in Shelbyville, according to Indianapolis Police Department.

Taylor and Worline, who have since ended their relationship, were expected to appear in court for an initial hearing today.
Neglect of a dependent resulting in death is a felony charge which carries a 20 to 50-year prison sentence.

Worline was being held at Marion County Jail on $50,000 bond, according to ABC. Taylor had been released after posting bail of a similar amount.

I totally agree with [MENTION=3446]Tundratot[/MENTION] , I think this woman hated the boy's father & THAT'S why she decided to keep him from her. I also bet she was using the baby as a barganing tool in the divorce & she never wanted the baby to be with him but she decided the psychological & emmotional pain the daddy was suffering was worth having her keep the baby.

It also explains why she hated this baby enough to abuse him. Those are the 1st things I thought off when I read the words: "limited contact... ongoing custody BATTLE.

And unless my ex was a child molester or a narcissist (read about Narcissism & Narcissistic Personality Disorder) or a drunk/drug user, I would only THEN BATTLE with my ex about keeping the children. There is no need for a BATTLE with a rational person nor their daddy unless one or the two are douchebags.

Wait! There is one more reason for a battle: if the ex was from a muslim country where they kill people for raping or what not & he wants to move back to his muslimland, I mean homeland.

But the mum and penis have been charged with neglect of a dependent resulting in death. Did they keep 'forgetting' to close the stairgate or something? Or are there more to the circumstances :S

They can always upgrade the charges once all the evidence is collected.

Maybe the 'neglect' would be for them waiting until Jayden was already dead before they bothered to take him to the hospital-- but then again, I'm sure they were too busy trying to get their stories straight and clean up the crime scene- Allegedly!
 
Father who reported abuse plans legal action against DCS
The father of a toddler who died from abuse in January has put the state Department of Child Services and a Shelbyville hospital on notice that he plans legal action to hold them accountable for his son’s death.

Indianapolis lawyer Michael J. Woody filed a tort claim notice — the first step required before filing a lawsuit against the state — against DCS on behalf of Jerraco Noel, Shelbyville.

Noel’s 1-year-old son, Jayden, died from abuse Jan. 18.

That was six months after Noel reported to DCS that his son had been abused. The child was treated for his injuries July 15, 2011, at the Major Hospital emergency room.

Woody also submitted a letter this week to the Shelbyville hospital, informing officials Noel plans to pursue a medical negligence claim against the hospital and emergency room doctor who treated Jayden.

“Children like Jayden are helpless,â€￾ Woody explained Friday. “Unless the professionals who are paid to protect these kids do their jobs, the children are at the mercy of their abusers.â€￾

In the tort claim notice filed against DCS, Noel alleges the agency “failed to conduct a reasonable investigationâ€￾ after he made a report to the agency last summer.

Stephanie McFarland, a DCS spokeswoman, confirmed the agency received Noel’s claim notice Thursday.

“We’re currently reviewing it,â€￾ she said, “and will await a formal response from the Attorney General’s office.â€￾

Noel is “asking DCS to take personal responsibility and accountability for its role in failing to protect Jayden,â€￾ the claim says. He is seeking $700,000 in damages, the state cap for such claims, “for loss of love and affectionâ€￾ of his son.

The agency investigated Noel’s report last summer, but “unsubstantiatedâ€￾ the allegation, according to DCS documents obtained by The Indianapolis Star through a public records request.

Noel contends that investigation was faulty. His claim says DCS failed to communicate with any of Jayden’s healthcare providers after the abuse report and also did not consult with any child abuse experts about the nature and alleged circumstances of Jayden’s injuries.

The shortcoming of that investigation and the failure of DCS to intervene, the claim says, resulted in Jayden’s death from a subsequent bout of abuse.

Jayden died from “multiple blunt-force traumatic injuries to the head,â€￾ the Marion County coroner determined. His death was ruled a homicide.

Jayden’s mother, Chelsea Taylor, and Ryan Worline, her boyfriend at the time Jayden died, have been charged with neglect of a dependent resulting in death.

Woody’s letter to the hospital contends the attending physician and nurses who treated the injured infant on July 15, 2011, “failed to put Jayden Noel’s safety first,â€￾ even though they initially suspected abuse. They “knew or should have known,â€￾ the letter says, that Jayden was at a high risk for abuse.

“Unfortunately, the healthcare providers in this case somehow decided that it was safe to send a baby back to an environment where heavy toys are being dropped on the baby’s head at four in the morning by the mom’s boyfriend,â€￾ the letter says.

A spokeswoman for hospital CEO Jack Horner said he could not comment on Noel’s claims. However, Horner last month defended the hospital’s handling of the case, saying staff acted appropriately and followed hospital policy.

A Marion County judge, however, disagreed.

In July, Judge Marilyn Moores criticized the emergency room doctor’s failure to notify DCS of Jayden’s hospital visit, saying the physician should have reported his suspicion that Jayden’s injuries were the result of abuse. That criticism was included in a court order approving The Star’s request for Jayden’s DCS records.

State officials basically have two options in responding to Noel’s claim: They can agree to pay a settlement or they can deny the claim. If it is denied, Noel can proceed with a lawsuit against DCS.

From 2006-2010, about 100 tort claim notices were filed against DCS, according to data provided to The Star earlier this year by the Attorney General’s office. All were denied.

Only about 20 of the people who submitted claims that were denied ultimately filed suits against the state, and just three resulted in settlements.

The state paid out a total of $297,000 in those cases. That included $210,000 to the family of an Indianapolis girl who died in a foster home after an advocate had raised concerns about the child’s care and safety.

Woody previously represented another child abuse victim’s family in case similar to Noel’s that resulted in a $400,000 jury verdict against Clarian Health Partners in 2008.

“Jerraco just wants the system to protect children,â€￾ Woody said of Noel’s motivation.

“We hope that holding those responsible accountable will help protect babies who are going to be in Jayden’s position in the future.â€￾

A jury has found a man guilty in the death of a one-year-old.

According to the Marion County Prosecutor's Office, on Thursday a jury found Ryan Worline guilty of murder and neglect of a dependent resulting in death, a Class A felony, in the January 2012 death of one-year-old Jayden Noel.

The jury also found the toddler's mother, Chelsea Taylor, guilty of neglect of a dependent resulting in death, a Class A felony, for failing to check on the welfare of the child, and also failure to get medical attention for the child.

So being that it is a Class A Felony I hope serious jail time comes with it. Long enough so this bitch can't have more kids. Forgiveness, with a plea for a tough sentence, was the theme of a sentencing hearing for a man convicted of murder in the death of a baby with Shelbyville ties.

Judge Lisa Borges of Marion County Criminal Court Four sentenced Ryan Worline to 65 years Wednesday. He will serve up to 55 years in prison and five years on probation. Five more years were suspended.

Borges showed some traces of emotion as she gave the sentence and her analyses of the “aggravating and mitigating” circumstances that played into her decision.

She agreed that she should take into account Worline’s lack of a criminal history and that separating him from his daughter could create a hardship.

But, she then bluntly dismissed Havonec’s idea that the Addison was too young to know what happened and sleeping when it happened by saying Addison was likely waken up by the noise the neighbors heard or by Jayden, who she said had to have been screaming.

Committing a violent crime in front of a child is, by statute, and aggravating circumstance.

She also mentioned text messaged between Worline and Taylor.

“The text messages indicated to me he hated Jayden,” she said. “I don’t know if it was being self-centered or jealous.”

She said that it seemed like being stuck with Jayden the night he died was the straw that caused him to “torture him to death.”

Worline also faced a fine of up to $10,000, which Borges declined to issue.

“There’s no amount of money that can compensate for a baby’s life,” she said.
