Ann Spaude is expected to make her first court appearance on Friday. She’s currently in the Marathon County Jail. Online court records show she’ll be charged with neglecting a child resulting in death. She’s already charged with bail jumping for allegedly violating the terms of her bond the night the boy died.
Officers from the Wausau Police Department responded to a home around 1:40 a.m. on Sept. 23, 2023. Officers found the baby lying on the floor with a person attempting to get the child to breathe. He was unresponsive. Officers used an oxygen mask to give the baby air in addition to chest compressions. The infant was pronounced dead at the scene.
Investigators said Spaude was lying the floor and appeared unphased by the incident. During an interview with police following the boy’s death, officers believed Spaude was intoxicated.
The baby’s mother said she laid the baby on the love seat around 7 p.m. or 7:30 p.m. She said her mother was sitting on the couch. The woman said it was the expectation that if the baby cried, her mother would come outside to tell her. Around 9 p.m. a bonfire was started in the backyard. Around midnight, Spaude came out to say the baby was crying. The mother and another person came in to change, feed and play with the baby. He went back to sleep on the love seat and was face up. Spaude was sleeping on the couch.
The mother said she later came inside to check on the baby and found him face down, with his head under Spaude. She rolled Spaude off, but said the baby was lifeless.
The baby’s cause of death was ruled asphyxia due to overlay.
