During a two-week trial last month, Andrew Wall had no shame or embarrassment in his voice as he insisted texts between himself and his girlfriend, Marlena Bennett, that had graphic descriptions of sexually abusing children with his girlfriend were fantasies. On Tuesday, a teary Wall silently shook his head, closed his eyes and fidgeted nervously while Court of King’s Bench Justice Shaina Leonard said she did not believe them.
Wall and Bennett were found guilty of sexually interference of a minor, and possessing and transmitting child pornography. A sexual assault charge against Wall was stayed. They were found not guilty of bestiality charges. The two former Fort McMurray residents will be sentenced in the near future. They remain in police custody.
The couple were charged in February 2021 after the National Child Exploitation Crime Centre detected images of child pornography uploaded online.

During the trial, Crown prosecutor Bonnie Parker described Wall as a sexual predator who preyed on children and manipulated Bennett into an accomplice. Bennett’s lawyer, Frank Carbonaro, described Bennett as lonely and traumatized from past sexual abuse, a failed marriage and multiple miscarriages. Wall took advantage of her, said Carbonaro, and Bennett was abused verbally, emotionally and psychologically.
Parker read multiple texts the couple sent each other between 2016 and 2020. They were read again on Tuesday by Leonard. They included detailed descriptions of sexually abusing children, including an infant the couple knew, and plans to manipulate parents into giving them access to children. Leonard agreed with Parker that some texts described real cases of abuse.

Bennett and Wall were also found guilty of sending each other child pornography, including images of a child they knew. Wall was also found guilty of possessing 14 images and videos of child pornography on his cell phone and laptop when he was charged.
Leonard found Bennett not guilty of bestiality and Wall not guilty of compelling bestiality. Texts from 2020 described Wall encouraging Bennett to sexually abuse her dog. Leonard said she believed Bennett knew Wall wanted her to do this. She also noted Bennett admitted during the trial she sexually abused a dog in 2016. But, Leonard ruled the Crown had not proven “beyond a reasonable doubt” that Bennett actually carried out this action in 2020.
 
An Alberta judge sentenced a Fort McMurray, Alta., woman to 10 years in prison on Wednesday, after she was convicted of child pornography charges and sexual interference of a minor.
Court of King's Bench Justice Shaina Leonard said Marlena Bennett, 37, committed the offences to appease her partner, Andrew Wall, but she still had high moral culpability.

Leonard also believes Bennett to be a risk to the public and children, because Bennett is still in a relationship with Wall and has been unwilling to end communication with him.
Bennett and Wall were arrested in February 2021, after police seized their computers and electronic devices in October 2020 and conducted a forensic analysis, according to the 2021 ALERT release.

The child pornography investigation involved an infant victim, police said.
Bennett was initially charged with two counts of distribution of child pornography, and one count each of possession of child porn, sexual assault, sexual interference and bestiality.

Earlier this year, she was found guilty of the child porn charges and sexual interference.
The judge also imposed multiple conditions on Bennett, including prohibiting her from communicating with Wall during her sentence. She also recommended that Bennett attend a program for sex offenders offered by Corrections Canada.
Defence lawyer Frank Carbonaro acknowledged Bennett's offences were severe, but argued her moral culpability was reduced because she was in an unhealthy relationship with Wall.

Bennett faced significant duress, coercion and bullying by Wall when she committed the offences, he said.
Leonard said Bennett's moral culpability was high, but agreed Wall's behaviour played a role. The judge noted Bennett had tried unsuccessfully to resist Wall and that she committed the offences to please him.

However, Bennett has stayed in touch with Wall since the arrest, and she considers them still in a relationship, Leonard said, adding that Bennett has been unwilling to stop communicating with Wall.
As a consequence, Leonard found Bennett is still a risk to the public and to children.

Wall has not yet been sentenced.
 
They had plenty of time to come up with, AND STICK TO, a plan that has them romantically bound to each other (because apparently they need that?) while still maintaining an outward appearance of at least TRYING to comply with the judges orders. They have ZERO self-preservation skills, which is the least of their combined issues. But her attorney is dead wrong on her culpability. She KNOWS how hard sexual abuse sucks, and she did it anyway. She WANTED to do this. Or she'd have be DONE with his ass long before now... :shifty:
