Day Care Temporarily Shut Down After Child's Death
San Diego Day Care Operator James Nemeth Had License Suspended By State
SAN DIEGO -- 10News learned that a day care run out of a home in Clairemont has been temporarily shut down after shocking allegations
On July 3, the state of California suspended the license of James Nemeth, the operator of San Diego Daycare.

The suspension notice states that a child suffered unexplained traumatic injuries including "bleeding in the eyes" while inside the day care. The boy died a day later on May 24.
The boy's father, Mike Oliver, spoke with 10News on Friday.
"This is just unbelievable," Oliver told 10News. "It's heartbreaking."
His son Louis died just four days before his first birthday.
"It's been very frustrating for us as a family not hearing anything about what's happened to my boy," said Oliver.
Oliver said that all investigators will tell him is that it is an ongoing investigation. Louis' autopsy results have not yet been released.

Earlier this month, a viewer tipped 10News to what they call Nemeth's suspicious and inappropriate behavior. The state's suspension notice stated that Nemeth wrestled with a man for approximately 10 minutes, bit the man and threatened "'There is going to be a fight'" and "'I'm going to kill you,'" all in front of a child.
Oliver said he wished he knew of Nemeth's history before placing Louis in his care.
"As a parent, I'm… paralyzed," he said.

In July, 10News tried to speak to Nemeth, but he refused to comment on the incident.
Mike Oliver, Louis' father, was too upset to discuss Friday's homicide ruling. His wife told 10News that instead of police notifying them of the update before it became public information on the Medical Examiner's website, they were notified by neighbors who saw the report on the news.
San Diego police did not comment on Friday's homicide ruling and did not reveal if any arrests have been made in the case.

....I always talked of putting my kid in daycare just so I could get a break ya know but shit after reading stories on here im just gonna suck it up and keep him at home !

WTF? Why the hell would they let parents here something like that on the news? Fucking assholes. I am also scared to death that my youngest starts school this year, it is so hard for me to trust anybody with my babies' safety.

A home day care owner has been arrested in the mysterious 2012 death of an infant who died in his care.

According to San Diego Police, James Patrick Nemeth, 38, was arrested on a residential street in Clairemont, just a mile away from where 11-month-old Lou Oliver died. He was then booked into County Jail and charged with first degree murder.

Lou was alert and healthy when he was dropped him off at the San Diego Daycare, also known as the James Nemeth Family Childcare, on May 23, 2012, according to this mother.

Just a few hours later, Lou’s mother, Cristina Oliver, got an alarming text message from Nemeth telling her to "come quickly, Lou did not wake up from his afternoon nap," Oliver told NBC 7 in February.

Deputy District Attorney Nicole Rooney alleged Nemeth lied about when he called 911, dialing the emergency number only after he talked on the phone with his mother for four minutes.

The baby was pronounced dead the next morning. Doctors testified that he had severe retinal hemorrhages and suffered non-accidental trauma.

Rooney alleged the defendant inflicted a head injury on the baby about eight days before fatally injuring him.

I just brought my twins home after 99 days in the NICU. I have had enough scary shit with them for a life time and now I have to worry about leavning them in childcare. What the fuck.
