According to an affidavit, officers were dispatched to an apartment shortly after 5:45 p.m. on Tuesday after a neighbor called and reported that the children in the apartment were left unattended. Officers say they arrived at the scene and located six children at the apartment with no adults supervising them. Authorities say the oldest child present was six-years-old, and the youngest was less than a year old.
An hour after the neighbor called 911 to report the children were not being supervised, officers spoke with the neighbor who called. An affidavit says she told officers that she saw one of the children running around outside of the apartment. The neighbor told authorities that the child said her mother left the children alone “so that means we can do whatever we want.”
Officers say the oldest child told them their mother, Brittany Smith, 29, had left to go visit their older brother in jail. Police say they were able to make contact with Smith by phone at 7 p.m.. Authorities say when officers told Smith they were at her apartment because her children were there alone, she claimed that one of her neighbors was supposed to be watching the children. That neighbor told authorities she was not asked to watch the children on that day, and that she has never watched the children before.
Authorities say the home was clean and there were no safety issues present, however DCS removed the children from Smith’s residence for the time being.
