Daimon D. Smith, 20, is charged with first-degree reckless homicide, according to court records. Smith is the father of the 5-month-old child.
On Aug. 5, 2023, Fitchburg police officers responded to a call at 9:44 p.m. regarding an unresponsive infant at an apartment on Fish Hatchery Road. Officer Jonathan Parker reported arriving at the scene where Smith handed over the baby, saying, “take her,” according to the complaint, which was filed Friday in Dane County Circuit Court.
The infant was not breathing and had milk or formula coming out of her mouth and nose, Parker reported.
Smith and the child's mother, claimed the baby had been choking and had respiratory issues due to premature birth. However, medical evaluations revealed significant injuries inconsistent with their account, according to Dr. Irene Hurst, a pediatric emergency physician.
An autopsy by Dr. Vincent Tranchida, a forensic pathologist, indicated the cause of death was blunt force trauma to the head, with additional fractures found in the infant’s arms and leg. Dr. Nancy Harper, a child abuse pediatrician, reviewed the case and categorized the injuries as highly indicative of child abuse.
