Next week, Elis Nelson Ortiz is heading to trial for the murder of his girlfriend's 4-year-old son. This comes after the boy, Giovanni Meijias, was found unresponsive at a home in Gaines Township back in June.

On Monday, Meijias' mother told FOX 17 that the whole thing was a horrible accident.

"I lost my child, and Nelson is innocent," said Sonja Hernandez, Giovanni's mother. "And he shouldn't be locked away from his children."

Ortiz's family is also standing behind him, declaring he is not guilty of what police are accusing him of.

"When he talks to me on the phone, he says 'sis, you know me better than anybody else. You know that I would not do this,'" said Delisha Ortiz, Elis' twin sister.

Ortiz was arrested in June after officials say Giovanni died from injuries to his abdomen. According to court documents, Ortiz told police he was trying to relieve the child's stomach bloating.

"Rub his tummy, hit his tummy because Nelson said he saw it getting inflamed," Elis' mother Nancy Nieves said. "Nelson said he thought [Giovanni] needed to vomit."

The Kent County Medical Examiner ruled Mejias' death a homicide, and said the boy had other older injuries on him in various stages of healing. Ortiz was later charged with open murder.

During his arraignment, Ortiz told a Wyoming district judge that he loved Giovanni like he was his own son and that he's not guilty.

"There's no way that my brother woke up and just snapped and killed one kid out of seven that were there," said Delisha Ortiz.

The man charged with abusing to death his girlfriend’s son broke down in tears as he learned he faces life in prison without the possibility of parole.

Elis Nelson Ortiz-Nieves was arraigned Thursday afternoon in 63rd District Court on murder, first-degree child abuse and being a habitual offender charges in connection to the death of 4-year-old Giovanni Mejias. He is being held in the Kent County Correctional Facility without bond.

The probable cause affidavit states that Ortiz-Nieves admitted to police that he dragged the 4-year-old boy from his bed to a shower and then said he used his hand to press on the child’s bloated stomach to “relieve pressure.”

But autopsy results determined Giovanni died from blunt force trauma to the abdomen and ruled out the possibility of accidental injury. Several older injuries in various stages of healing were found during the autopsy.

Ortiz-Nieves seemed stunned and confounded as Judge Sara Smolenski detailed the accusations against him.

You do not hit a child to make them vomit. You hit them to hurt them.

And we see everyday on here where one child out of the family is chosen to be the whipping boy, no matter what is going on, one particular child is chosen to be punished, beat, whipped, drowned, waterboarded, whatever their imaginations can come up with. And most of the time, it's for no apparent reason that makes sense to reasonable people.

A judge’s stern words for a Gaines Township man convicted of murdering his girlfriend’s 4-year-old son were cut short Thursday, when the suspect got into a courtroom scuffle.

Judge Mark Trusock was recounting testimony about the abuse leading up to the death of 4-year-old Giovanni Mejias when it happened.

Trusock said what Elis Nelson Ortiz-Nieves, 25, did to the boy was gruesome, including seven blows to the head and putting out cigarettes on his body. The judge was describing belt-buckle shaped bruises on the boy when Ortiz-Nieves interrupted.

“I ain’t going to let you- I ain’t going to let you say those crazy (expletive) about me, man. No man, because he don’t even know, man,” Ortiz-Nieves said, turning to a courtroom officer.

When the judge continued describing the abuse, Ortiz-Nieves began struggling with officers. Shouts and crying could be heard coming from two female supporters of Ortiz-Nieves as he was led out of the courtroom.

“Anyone says anything back there, arrest them,” Trusock ordered bailiffs.

Shortly after the scuffle, Ortiz-Nieves was led back into the room.

A jury found Ortiz-Nieves guilty of felony murder and first-degree child abuse last month.

Ortiz-Nieves previously told detectives that after he found the boy stiff and unresponsive, he kept pouring water into his mouth. He also allegedly told detectives he was jabbing Giovanni in the stomach in an effort to get him to vomit. On Thursday, he maintained his innocence.

“I’m going to continue to say that I will take a lie detector test to prove I never abused any of (the) kids or never abused Giovanni and never intentionally meant to hurt Giovanni, but to help him,” he told the court.

Kent County Circuit Court Judge Mark Trusock wasn’t having it.

“You can claim your innocence, but I sat over this trial and carefully listened to all of the testimony and the jury verdict was clearly correct in this matter. There is no question whatsoever that you committed this murder and you beat this little boy to death,” Trusock said.

“There is no question in my mind that you did this,” he continued. “You are the lowest form of human life that I have been able to observe or see. You are a monster and quite frankly, you are evil. What you did was sickening and disgusting.”

He sentenced Ortiz-Nieves to life in prison without the possibility of parole.

The mother of a 5-year-old boy murdered by her boyfriend is now behind bars after she was charged with failing to protect her child and lying to police.

On Saturday, Sonja Hernandez spoke to 24 Hour News 8 via Internet from the Kent County Jail.

It started on June 13 when police found Giovanni Mejias dying at the Cutlerville mobile home he shared with his mother, his four siblings and his mother’s boyfriend, Elis Nelson Ortiz-Nieves.

He would be arrested charged and found guilty of the boy’s murder. Ortiz-Nieves maintained that he was trying to save the boy even as he was being sentenced last month.

But testimony showed that the child suffered at least seven blows to the head and there was evidence he had cigarette burns on his body.

Hernandez also maintained that he was innocent.

She was arrested last week and charged with child abuse for failing to protect Giovanni and her four surviving children from her boyfriend’s abuse. She is also charged with lying to investigators — they say she tried to blame her son’s death on one of her other children — a charge she flatly denies.

“Everybody who knows me as a person knows that I am a great parent, so I don’t care about what anybody has to say,” said Hernandez.

When asked if her boyfriend is where he belongs, she doesn’t have as much to say.

“I have no comment on that,” she says.

And does she still love the man convicted of killing her son?

“I have no comment on that,” she said.

She says that police wanted her to testify against Ortiz-Nieves.

“If I bashed him like they wanted me to, I wouldn’t be in this position right now,” Hernandez said. “They’re just trying to make an example out of me.”

Hernandez says she is a good mother.

“Of course, I work three jobs to support my children with no assistance,” she said. “My kids know that I love them and I’m gonna do everything so I can get them back.”

She said she believes she will be proven innocent.

“My family’s trying to get me out and I told them, ‘No, I gotta prove my innocence.’”

Acknowledging Hernandez was abused as a child, 17th Circuit Court Judge Dennis Leiber said she has no excuse for her actions.

"There's no justification or excuse for abandoning your most sacred responsibility, that is to care for the children who you claim to love," said Judge Leiber.

A “monster’ who beat a 4-year-old boy to death will remain in prison after losing a bid to have his 2017 convictions overturned.

Elis Nelson Ortiz-Nieves appealed his convictions for felony murder and first-degree child abuse, saying his attorney was ineffective and some trial testimony “was based on junk science.’’

He also objected to jurors hearing about his “past episodes of domestic violence and violence toward children.’’

In a recent 10-page decision, the Michigan Court of Appeals disagreed. “We find no merit in any of these contentions,’’ the three-judge panel wrote.

Jurors deliberated about an hour before returning guilty verdicts two years ago.

Ortiz-Nieves was sentenced to mandatory life in prison.

During sentencing, Kent County Circuit Court Judge Mark Trusock called the June 13, 2017 beating death of Giovanni Mejias “sickening and disgusting.’’

“You are the lowest form of human life that I’ve been able to observe or see,’’ Trusock said at the time. “You are a monster and quite frankly, you are evil. What you did was sickening and disgusting. You should never be allowed out of prison.’’

Ortiz-Nieves at one point had to be forcibly removed from court after becoming upset as Trusock described injuries suffered by the boy.

Sugarcookie, you obviously haven’t followed up on this much. The mother, was not charged with perjury. She was only charged with 2nd degree child abuse and sentenced to 4 years and 9 months to 10 years. She was released in October of 2022. I’m not sure how much you followed this case, but she had 10 open CPS cases against her prior to Nelson being involved in her and her kids lives. Her oldest son had anger issues and was suspended from school for causing over $1000 in damages. While he was suspended, the babysitter (in the trailer park), had to watch him, and he caused damages to her trailer. Multiple witnesses from the trailer park said they witnessed the oldest son being very rough and violent with Giovanni. Punching him in the stomach. Riding his bike with Gio on the front handle bars and braking hard so Gio would fly forward off the handle bars. There were also incidents of which Gio confessed to Nelson that his older brother was doing to him. The older brother was also seen/heard by his other siblings that there was a dead body in the kitchen (I believe that was the room), and that he had claimed he heard people or someone/something talking to him in his bedroom. He had issues that were not reported to a doctor that could have been treated. The 10 open CPS cases, which the medical examiner stated there were many injuries in multiple stages of healing, were not taken into consideration nor were the 10 open CPS cases against the mother. The medical examiner stated that the cause of death was due to blunt force trauma to the abdomen. Yet when the autopsy also showed injuries to the head and ribs, legs, etc., that’s when the jury and judge decided they were also caused by Nelson? The majority of the CPS cases were from the other kid’s father, and they were not all from the short time Nelson and Sonja were together. I know the mother of Nelson’s godchild who was there, who is also the grandmother of his daughter who was there, and she told me a lot about how Sonja was with Gio even before anything ever happened. Well before Gio died. Sonja whopped Gio beyond belief when he had an accident in his pants, to the point where he was screaming. It happened at her house. She witnessed it. He was and is a great father. Sonja lied over and over again and when she learned of her charges, she changed her story. She also had a domestic violence case pending against her for the father of her other children. She’s a wicked person…a wicked mother. She was a known trick (just didn’t stand on the corners on Division). Unfortunately, I know some people who have paid for her services. That was back in 2013, well before Nelson. So who had her kids? She was known to leave her kids alone, and that’s proof, I just won’t mention anyone’s names out of respect as they have changed their lives around. Nelson may not have been innocent of everything, as I do not know everything that went on behind closed doors, but I do know he did NOT kill Gio.

Well the jury believed he did as did the judge (btw love love love that judge) and the judges at the appellate court reiterated as much in a ten page summary.
I’ll grant you the fact that mom’s also a scum of the earth lying pig whore who should still be in prison rotting next to him. But life is full of disappointment.

You obviously haven’t read through all of the testimony from all of the children, or seen the testimony from her where she protected him until she was told what she faced. She changed her story, as did her mother. There are public records that show the 12 open CPS cases that were opened prior to him being involved, and also show that the father of her older kids dad was involved, and also her brother, the kids “Tio”. You said you’ve seen this too many times… you must know a lot about the CPS system or families who blame others for murder. You aren’t very smart, so you should look into the laws and the entire case (including all affidavits, CPS reports, etc., before opening your mouth!

What is this guy to you? He was the one hitting the child's stomach even after he found the child unresponsive.. he jabs him in the stomach instead of doing cpr. That's just assinine. And why was he the one to find him unresponsive and not the mother? Where was she?

From one of the above articles she said she worked 3 jobs with no assistance.. was she at work and he was at home babysitting?

Why do you keep coming on here trying (unsuccessfully) to change people’s opinion of this convicted child abusing murderer? Even if you could it’s not like anyone here can undo the decisions of a 12 person jury, judge, and 3 Appellate judges.
If you’re trying to show mom’s a horrible lying child beating Ho bag who should be in prison and never allowed near a child again-I’m sure everyone already agrees.
