OKLAHOMA CITY -- Police in Oklahoma City investigate a tragic case of child abuse. A 3-year-old girl is found beaten to death. The girl's mother and boyfriend are behind bars accused of the murder.
It happened at an apartment complex near 122nd St. and Stratford Dr.
That's where Victoria Phanhtharath is accused of abusing and killing her little girl.
In addition to the victim's mother, the boyfriend, Freddy Mendez, is also charged with murder.
Neighbors admit they're stunned by the girls death and the criminal case against the couple.
"There's no words to describe when a child dies before they have the chance to live. It's ridiculous," neighbor Thomas Justice said.
Neighbors say the suspects initally told them the child died from chocking while eating breakfast.
Investigators say the truth is much more sinister.
"The child showed multiple signs of abuse, according to medical personnel. Sadly, the child succumbed to her injuries," OK Police MSgt. Gary Knight said.
Knight said by the time officers arrived at the suspects' apartment, the little girl already appeared unresponsive.
Right now it's unclear if the alleged abuse had been ongoing or what sparked the fatal incident.
"Anytime you deal with a homicide, it's a tragedy, but it's shocking to the conscience when it's a 3-year-old child who dies from someone who is supposed to love them," MSgt. Knight said.
The two suspects remain behind bars at the county jail.

Oklahoma City police say they were called about an unresponsive 3-year-old child in the 12800 block of Stratford Drive about 9:20 a.m. Sunday.
Hawkins was then transported to Children’s Hospital, where medical personnel informed officers that she showed multiple signs of abuse.
Officers then interviewed and subsequently arrested Phanhtharath and Mendez on child abuse charges.
Phanhtharath was Hawkins’ biological mother and Mendez was Phanhtharath’s boyfriend.
A neighbor, Chiquita Thrower, said, “From my bedroom window I heard her screaming and crying. I figured something bad had happened.â€￾
Another neighbor told Eyewitness News 5 that he heard loud banging and screaming coming from the apartment above. He said at one point the floors shook.
Both Phanhtharath and Mendez have previously been arrested for possession of marijuana in separate incidences.

Police interviewed the child's mother Victoria Phanhtharath, 22, and her boyfriend, Freddy Mendez, 24. Phanhtharath said before Alexis was taken to the hospital, Mendez had been yelling at her because she wouldn't eat. She said Mendez told her to get a shoe so he could spank the little girl.
Phanhtharath retrieved a brown, braided leather shoe and said Mendez hit the child all over her body with it. She said this was not the first time Mendez had beaten the child. She said in the past, Mendez had also picked up Alexis by the neck and "shaken her like a rag doll."
Phanhtharath said Mendez eventually told her to take care of Alexis because he did not want to deal with her. Phanhtharath said she took her daughter to a bedroom and became so frustrated she shoved the little girl, and that's when the child struck her head on a wooden baby bed.
Phanhtharath said Alexis began choking and her eyes rolled back into her head. That's when the couple took the girl to the hospital. Alexis died Monday, October 31, from her injuries.

Ptttouey actively helped Mendacious abuse and kill her little girl. And I can see why. Those blue eyes and that light brown hair did not look like either of those monsters. Had to get rid of her because she was different.

My dad abused my mom but would never let him touch us. One day she took a beating so bad, she hid a butcher knife under her pillow and got on her knees and prayed. Because...she was going to kill him..but she didn't..she left and took me and my sis with her...and made sure we never had to see this type of abuse. People are heartless..there even more cruel when it happens to a child.

The mother of a 3-year-old girl who was beaten to death was sentenced Monday to 35 years in prison for enabling the child's abuse and murder.

Victoria Phanhtharath, 23, avoided a trial after reaching a deal with prosecutors.

She received a life sentence with all but the first 35 years suspended in exchange for her testimony against her boyfriend, Freddy Mendez.

Phanhtharath did not speak in court.

Mendez, 25, is accused of killing Alexis Hawkins, who died of head and blunt force trauma, according to the state medical examiner's office.

Alexis died of her injuries Oct. 30, 2011, at The Children's Hospital at OU Medical Center. . . .

But during a jail interview a few weeks after the girl's death, Phanhtharath told investigators that Mendez picked up the girl and slammed her to the floor so hard the back of her head bounced, a police detective testified at the couple's preliminary hearing in June.

Mendez then started punching and kicking the girl, the detective said the mother told him.

Phanhtharath told the detective she lied to cover up for Mendez, who she said beat her and the girl regularly.

The detective also testified that the state Department of Human Services was called twice to investigate reports of abuse by Phanhtharath, who has a son with Mendez.

A physician who treated Alexis testified she was covered with bruises and “clinically deadâ€￾ with a massive skull fracture to the back of her head when she arrived at the emergency room.

Oklahoma City Judge Kenneth Watson has now modified Phanhtharath’s sentence and allowed her to go free for time served.

Judge Watson says he stands by his modification based on the testimony he heard.

It was Freddy Mendez, Phanhtharath’s boyfriend at the time of the murder of her daughter in 2011, who was accused of killing little Alexis.

Alexis had bruises all over her body when she was admitted to the hospital, and a massive skull fracture and severe brain swelling. She died the next day from her injuries.

District Attorney David Prater does not view this case as having justice served and released the following statement:

"The District Attorney's office strongly opposed the modification of sentence resulting in the immediate release of Victoria Phantharath from prison. Prosecutors strongly argued that despite the fact Phantharath did not personally inflict injuries on her daughter, she wholly failed to protect her daughter from the homicidal actions of her boyfriend."

"She was legally and morally responsible for the protection of her daughter, and she stood by and allowed the child to be savagely beaten to death by Freddie Mendez."

"Nevertheless, regardless of her cooperation in that prosecution, justice was not served by her sentence modification to an immediate release from incarceration."

Phanhtharath’s release does come with conditions, including counseling and living in transitional housing. She will also be under supervision by the Department of Corrections for a minimum of 10 years.

This is the sad truth behind a lot of the long sentences they dish out in the US. An awful lot of people don't serve near the time they got.
 
We keep saying it but until we as a nation actually FIGHT for these kids this shit won't change. We are so pissed off about the legalization of marijauna yet we don't bat an eyelash when we turn on the news and hear of another baby dying at the hands of some tard. Something has to give.
Is there anyway we can write this Judge a letter telling him what a awful decision he made? All this bitch knows is popping out kids with irresponsible "men" so what makes this Judge think she's magically changed after 2yrs in jail?

I watch documentaries all the time and I saw one about inmates in Angola prison in Louisiana. Some of the inmates were doing 40 years for robbery, another was doing life because the 3 strikes law. I was horrified that child abusers, baby torturers get LESS time than them!! I just don't know how any judge can sleep at night knowing a baby died tortured because the mom was too busy worshipping the dick and now she's free.

I have to wonder at the mindset of our lawmakers, what holds them back from throwing these bastards in jail and throwing the key away?
 
That baby's face is burned into my brain. I just can't wrap my mind around hurting my child, let alone standing by while someone else does. I literally get nauseated and feel sorry for DAYS or more, if I have to punish my son for LEGITIMATE reasons, like throwing a toy monster truck at my face!! I am a smart, educated woman who lives by my common sense...I understand just about everything, it doesn't mean I agree with everything, but I get it...this kind of shit, I just don't understand. I have nightmares that I may have raised my voice too loud and scared my son...how can someone put their hands on a child like that? Why? Because shits like this are sub-fucking-human and don't deserve to breathe the same air as we do. Two years? Really??!! FUCKING REALLY!!!!!??? (deep breath jo)

I have been around violence as a kid being the star recipient of it...

I have a lot of trouble with these type of cases. I remember what it was like to be terrified of the person you are married to. However, I also know I left when our daughter was born. BUT.... I actually allowed ot briefly reappear in our lives 8 years later. Anyway, long story short I cannot expect every woman to be in an abusive relationship with or without children to act the same way. None of us are without fault and I tend to empathize with abused women knowing their pain and fear.
