Clinton Township police are expected to charge a woman in the murder of her four-year-old grandson after responding to a call Monday that the child had drowned in three inches of bathwater.

Fox 2 reports an autopsy revealed DeAngelo Tobia did not die by accident, and a friend of the family tells the television station the grandmother told the child's mother she killed him.

"The grandma said she... strangled him and then she put him in the bathtub," Eman Kannah said.

The grandmother, who is in her 60's, was watching the four-year-old at the time of his death, and his aunt told Fox 2 she'd done so many times without trouble.

"In a million years, we would never think that she would do anything to harm a kid like that because no one would drop off a kid to their grandma's house or anybody's house if they know their (kid is) going to be in danger," said Lina Najor."

Terry Rita Borgia could face life in prison if convicted of the murder of her 4-year-old grandson, who Clinton Township authorities found non-responsive in a bathtub on Monday.

The Detroit News reports Borgia, 60, yesterday appeared in District Court via video feed as she was arraigned on a charge of first-degree premeditated murder or an alternate charge of murder in the commission of a felony, including child abuse.

After the hearing, Fox 2 cameras recorded a stream of distraught relatives, including the boy's parents, leave the courtroom in tears.

Father Bashar Tobia had to be helped from his seat.

Emergency crews on Monday responded to a call from Borgia's house, where they found 4-year-old DeAngelo Tobia unconscious in a bathtub.

The daughters of a woman accused of drowning her grandson said their mother was depressed and suicidal in recent years, but had been a good and loving mother and grandmother.
Vickie, 35, daughter of Terry Borgia, 60, said Wednesday outside a courtroom that her mother frequently babysat all of her grandchildren, including Vickie’s two daughters.
“She had had my children from Day One and loved my children,â€￾ said Vickie, who declined to give her surname. “She gave them popsicles, she took them to the pool, she took them for walks.
“My mother was always on top of everything.â€￾
other daughter, Tonina, 25, said her mother was a good listener and “always thereâ€￾ for her children and grandchildren.
That’s why they said they were shocked when their mother was accused of drowning DeAngelo Tobia, 4, in January in the bathtub of her Clinton Township apartment while babysitting. She is charged with first-degree murder, but has been found mentally incompetent to assist in her defense. She was ordered Wednesday by Judge Sheila Miller of 41B District Court to return to a state psychiatric center near Flint to try to regain competency.
The deceased boy was the son of Amelia, 33, who attended the hearing but was unavailable for comment; she is the sister of Vickie and Tonina.
Vickie said although they knew Borgia had issues, “never in a million yearsâ€￾ would they think their mother would kill one of her grandchildren.

Confession complications: Grandmother is charged with Clinton Twp. child killing, but aunt says she may be guilty

The aunt of a 4-year-old boy who drowned in the apartment they shared with her mother has added more fuel to possibility that she, not her mother, may have committed the act.

The woman a few weeks ago went to a Clinton Township police detective and said she wanted to confess to killing her nephew, DeAngelo Tobia, because her mother, Terry Borgia, could not have done it, according to attorneys involved in the case. But she didn’t provide a confession or details; it was more of an implication, they said.

“She said that her mother is a good woman couldn’t have done it,â€￾ assistant Macomb prosecutor William Cataldo said. “She said since her mother couldn’t have done it, she must have.â€￾

During the one hour interview with Detective William Furno, the woman talked about many other issues in her life but didn’t provide more information about the crime, attorneys said.

Due to the lack of evidence that the aunt was involved, the matter remains under investigation and on its current legal path in which Borgia, 62, is charged with first-degree murder and child abuse.

An evidentiary hearing regarding the admissibility of her police statement is set for July 8 in front of Judge Peter J. Maceroni in Macomb County Circuit Court in Mount Clemens.

“It (aunt’s statements) will be an issue in her trial,â€￾ said Borgia’s defense attorney, Mark Haddad.

The then 24-year-old aunt was in the apartment and called 911 in January 2010 when DeAngelo was found lifeless in a bathtub January 2010 in the bathtub of Borgia’s unit at Clinton Place Apartments.

Borgia made admissions in a statement but was initially found incompetent to face trial due to mental issues. She subsequently gained competency in treatment at a state psychiatric facility.

The possibility that the aunt living with the boy may be involved first surfaced in court about two months ago when it was revealed that Dr. Ronald Fenton, who examined Borgia, believes Borgia may be taking the blame for someone else.

I know I'm totally diving off into Assumption Land...but what if the aunt had "issues" like losing time (DID), etc....everyone knew the grandma was awesome. Aunt does it, grandma covers for her out of misplaced love & guilt for whatever happened to her daughter (aunt) in her youth. Aunt knows she herself could be capable so says what she does, simply because she wants to do the right thing.

Meanwhile, HOW can a family heal after something like this? It is BEYOND tragic.

This is such a twisted story...it gives me a little headache. But @whisperwing is right, lose - lose situation for sure.
 

Borgia to be tried for the FOURTH time:
Macomb County prosecutors have amended the charges against a grandmother accused of drowning her 4-year-old grandson three years ago.

Terry Borgia, 63, will face felony murder, first-degree child abuse and involuntary manslaughter during a trial that is to start March 5 in Macomb County Circuit Court.

A charge of first-degree, premeditated murder was withdrawn.

The move today during a pretrial hearing was not completely unexpected. The prosecution had said it might reconfigure the charges after a third mistrial in the case occurred in December when a jury deadlocked.

Judge Peter Maceroni, who has presided over the case, previously said the jury was unanimous that Borgia was not guilty of first-degree murder, but was split on felony murder and second-degree murder.

Assistant Prosecutor Bill Cataldo said the change in the charges is “just to make it easier and more understandable for the jury.â€￾

Borgia’s attorney Mark Haddad said that he thinks “it will be easier to get a conviction on the amended charges. It’ll make my job that much more difficult.â€￾

Borgia has been behind bars since Jan. 11, 2010, in the death of DeAngelo Tobia at her Clinton Township apartment.

Borgia and one of her daughters, Tonina Borgia, were the only adults in the apartment when the boy died. Haddad said Terry Borgia is covering for her daughter. Cataldo has said there is no evidence to charge the daughter.

Cataldo said the manslaughter charge is a negligence standard.

“(Terry Borgia) has admitted to negligence by placing the child in a bathtub while the child was sleeping,â€￾ he said.

But Haddad said until his client “comes clean and says something different, in my mind, she’s taking the blame for something she didn’t do.â€￾

Terry Borgia faces life in prison if convicted of the murder charge, up to life if convicted of the child abuse charge and up to 15 years if convicted of involuntary manslaughter, Cataldo said.

Borgia’s first trial ended in a mistrial after police statements were found to be invalid. Her second trial ended in a hung jury after Borgia’s daughter Tonina was found to be an unfit witness after mental health issues. Her third trial ended in a mistrial after jurors indicated they were deadlocked.

Do they get to just adjusting the charges and retrying her until something sticks? I call that abuse of the system, if the evidence is that iffy, maybe someone needs to reinvestigate and look for some better evidence.

A Macomb County judge upheld the guilty verdict of a 64-year-old woman in the drowning death of her 4-year-old grandson even though he disagreed with it.

Judge Peter J. Maceroni on Wednesday denied a new trial for Terry Borgia, who in her fourth trial in March was convicted of felony murder and child abuse for the January 2010 drowning death of DeAngelo Tobia in her bathtub.

During an emotional circuit court hearing, a choked-up Maceroni said it was the most difficult sentencing of his judicial career. He said he was bound by law to deny another trial.

“This is my 23rd year on the bench, and this is by far the most difficult sentence I’ve ever had to impose,â€￾ he said. “Although the jury saw it one way, case law says even if the court feels another way, I can’t do anything about it from a legal standpoint.â€￾

Borgia was convicted in her fourth trial after two trials were aborted for legal reasons, and a third jury deadlocked. Maceroni noted that two of the juries were leaning toward not guilty verdicts.

Maceroni also noted the evidence was circumstantial.

DeAngelo’s parents, Bashar and Amelia Alkasmikha; his aunt, Vickie Borgia; and Borgia’s defense attorney, Mark Haddad, believe that Borgia is covering up for her daughter, Tonina Borgia, DeAngelo’s aunt who also was in the apartment at the time of his death.

Bashar Alkasmikha outside court criticized Clinton Township police, saying they should have investigated both Terry and Tonina Borgia.

“We feel they got the wrong one,â€￾ he said. “I wasn’t there at the time, but there were two people at that home. They should have arrested both of them at the time. They should have questioned both of them. … They should have put them in separate rooms and investigated them further. Instead, they just arrested the mom and let the daughter go. That’s basically what they did. That’s what got us no justice.â€￾

Amelia Alkasmikha added: “And now my mom’s going to prison for the rest of her life.â€￾

She said that while visiting Borgia at the Macomb County Jail before the last trial, her mother gestured with her hand and mouthed to her, “I didn’t do it.â€￾

Tonina Borgia, whose family said is now living in northern Macomb County, did not attend the hearing and has appeared in court for the case only once, last November when she denied killing her nephew.

That was after she went to the police station in 2011 and told a detective she killed DeAngelo, although during testimony she said she made the comments during a “psychotic breakâ€￾ when not taking her medications for bipolar and other psychological issues.

Tonina, now 28 or 29, has been taking medications since age 23 and at the time of her testimony was under court order to take them.

Vickie Borgia said Tonina was not taking medications at the time of the drowning.

Assistant Macomb prosecutor William Cataldo said Wednesday he sympathizes with DeAngelo’s parents but is certain he convicted the right person. He noted Borgia told four police officers and Vickie Borgia that she did it.

Bashar Alkasmikha said he and his wife appreciate the judge despite denying the new-trial motion.

The request for a new trial was based on a comment made by Cataldo during closing arguments when he said if Borgia was covering up for Tonina, she would have pleaded guilty.

The remark improperly swayed the jury against Borgia, Haddad contended.

But Cataldo argued Judge Maceroni cured the mistake with a jury instruction to ignore it. Cataldo pointed to prior case law that indicates such a comment was not severe enough to reverse a verdict, noting that closing arguments are not evidence during which lawyers often have made wild claims.

Ironically, Borgia in February 2012 pleaded no contest to first-degree murder, but Maceroni took it under advisement and Haddad, with input from her family, filed a motion to withdraw it.

Borgia has an automatic right to appeal, at which Haddad believes she has a good chance at reversal.

Amelia Alkasmikha said she will “fightâ€￾ for her mother and plans to visit her in prison. She hopes her mother will reveal what happened the morning DeAngelo was held under water in a bathtub of Borgia’s Clinton Township apartment.
