The El Paso Police Department is investigating the death of 4-year-old Dallas Ryan Macias.

According to police, Macias died Sunday after receiving serious head injuries. He was taken to an area hospital on Saturday, March 12th.

One local hospital worker told KFOX14 she was there when Macias was getting checked out. According to that worker, Macias suffered serious neck injuries, including a neck fracture and skull injury.

That worker also said the story Macias' caregivers told medical staff changed. According to the worker, first they said Macias fell off the bed, but then said he fell in the tub.

"They would have to fall from...a very high place to fracture all that," said the worker. "The bones are very fragile."

His aunt and uncle said they are simply trying to move past the sudden death of their nephew, Dallas Ryan Macias.

"I used to have phone calls from him saying 'Tio, I love you.'" said Vince Barreda, Macias' uncle. "Just knowing that I won't be hearing that anymore ... it's just hard to accept."

Child Protective Services are also investigating this case. CPS confirmed there have been no prior incidents with the family in question. A CPS representative also confirmed no other children in the household have been taken into protective custody following this incident.

Justin Underwood, who is representing Macias' caregivers, told KFOX14 they did nothing wrong. He said both people are "devastated." Underwood also said the caregivers tried to get Macias medical care as soon as possible. According to Underwood, Macias was taken to a local hospital within 25 minutes of the incident.

"People who do bad things don't typically rush their victim to the hospital," said Underwood.

Underwood also said claims that the parents changed the story of what they told medical staff about what happened when Dallas got hurt are unfounded.

"They did not change their story," said Underwood.

An arrest affidavit described Dallas Macias' injuries and alleged a history of abuse at the hands of his mother, Vikki Macias.

Macias, 26, is charged with capital murder in her son's death. She turned herself in to police Monday after a warrant for her arrest was issued.

Her arrest affidavit said an autopsy revealed Dallas Macias died from blunt force injury to the head. It listed the manner of death as homicide. . . .

The affidavit said Dallas Macias had bleeding in the brain and a fractured spine. It also said the child had a healing fracture in his left leg. The affidavit alleged that the fracture was left untreated by Vikki Macias.

“If he was jumping up and down on the bed and jumping in the air off the bed and landing on his head, or if maybe he climbed on something else,” said Justin Underwood, Macias’ attorney, in giving potential explanations for the injuries. “My client was not in the room when this happened.”

Underwood said Dallas was healthy and active in the very moments leading to his deadly injury on March 13, 2011. He said it was a typical Saturday morning in the Macias household. He said Vikki was doing laundry while Dallas played in another room.

“She walked by. He was playing on his bed one minute, and that’s the last time she saw him before she heard a noise and went in, and he was unresponsive,” said Underwood.

He said Macias screamed and attempted to revive him. Within 25 minutes, he said she had taken him to Sierra Medical Center East, a hospital about one mile away from her east El Paso home.

“He was alert at that hospital,” said Underwood. “He was talking to his mother. He was talking to the nursing staff.”

Underwood said Dallas was kept there for nearly 2 hours before being transferred to University Medical Center. Dallas Macias died at UMC the next day.

"Two hours at a hospital for them to send you somewhere else? When it's a four-year-old with a brain hemorrhage? I have a problem with that. I have a real big problem with that," said Underwood. “One of the physicians down there [at UMC] said, ‘What took you so long to get him here?’ That’s not in your police affidavit, and that’s not in your report. But these are facts that will come out because this was a horrible accident.”

Macias’ arrest affidavit also said, "Investigators are in possession of statements and reports that outline a history of abuse by the defendant against the victim."

"Show them to me," said Underwood. "Because this news station, who was first to report it last week, reported that CPS has nothing on them. So these are all allegations."

. . . Vince Barreda, Vikki's brother, said Dallas was "a handful" but was never too much for his sister to handle. He said she did sometimes spank him, but it wasn't enough to do damage.

"There were times that she did have to spank him but it was never excessive force to where we would be like 'Hey, you're going to hurt Dallas,'" said Barreda. "It never got to that point."

Barreda said Dallas was not afraid of his mother, and that they had a very loving relationship.

"I don't see my sister capable of killing my nephew," said Barreda.

Barreda said his sister does not have a prior history of abuse, despite claims by the El Paso Police Department. Citing the fact that child protective services have no prior records with Vikki Macias. According to Barreda, several people have approached the police department to issue statements regarding Vikki's parenting. But Barreda said those people are not in full possession of the facts.

But family members admit Vikki's life wasn't perfect. She has three other children, but lost custody of them in a divorce. Also at a time prior to Dallas' death, Vikki and Dallas were not heard from for over one month. That made Barreda and other extended family members go to police to request a "wellness check" to ensure both were ok.. . .

Mistrial declared in capital murder trial of woman accused of fatally beating son
Following a police detective's emotional breakdown while on the stand, a state district court judge declared a mistrial Tuesday in the murder trial of a 27-year-old woman accused of fatally beating her 4-year-old son.

Judge Gonzalo Garcia of the 210th District Court halted the trial of Vikki Macias after El Paso police Detective Rosalynn Carrasco began sobbing on the stand after being asked about the death of Macias' son, Dallas Ryan Macias.

Dallas died in March 2011 at University Medical Center, where he was being treated for a fractured skull and brain swelling. At the time, Carrasco was a detective with the Police Department's Crimes Against Children unit.
The unit investigates major crimes such as homicides and sexual assaults.

Carrasco has been with the department for about 10 years. She is now assigned to the department's Internal Affairs unit.

Defense attorneys Richard Esper and Rebecca Tavitas said in court they feared Carrasco's tears would unfairly prejudice the jury. Garcia agreed and then declared a mistrial.

A new trial for Macias has been tentatively scheduled for June 15.

Because of a gag order issued by Garcia, both defense attorneys and state prosecutors declined comment after Tuesday's proceedings. [...]

Poor little guy didn't stand a chance with the bed and the bath tub ganging up on him. As we Demons are all aware, just one of those seemingly innocent household items can be lethal to kids.

Jumping up and down and climbing with a healing leg fracture? Was he one of those kids who feel no pain?


He looks happy enough in those photo's, but kind of 'puny'. My kids are skinny, but Dallas looks.....fragile, somehow.

Vikki Macias was sentenced to 15 years in prison for the death of her 4-year-old son in 2011, a lesser charge than she originally faced. Today, the boy's grandmother speaks to CBS4 and says she does not agree with the judge's decision and plans to appeal.
