An Iowa man who set fire to a church LGBTQ flag in June was sentenced Wednesday to over 15 years in prison.

Adolfo Martinez, 30, was found guilty last month of a hate crime, third-degree harassment and reckless use of fire, the Des Moines Register reported.

Martinez stole an LGBTQ flag hanging from the United Church of Christ in Ames – about 35 miles north of Des Moines – and set it on fire outside a strip club on June 11, police said.
Martinez admitted to police that he stole the flag from church and burned it because he opposed homosexuality.
Martinez was arrested in June and convicted last month.

He received 15 years for the hate crime of arson, one year for the reckless use of explosives or fire and 30 days for harassment.

Damn. Fifteen years for burning a flag? Excessive much? I wonder how many prisoners they have who burned the AMERICAN flag. My guess is zero. W-T-F?
There was a guy by the name of "Joey" Johnson who got hold of an American flag and burned it in protest, subsequently being arrested and charged with dishonoring disrespecting the flag. The case went all the way to the US Supreme Court, which ruled that the act of burning the American flag is an act of free speech and laws prohibiting it are unConstitutional.

You're right. Zero.

Just today they sentanced someone that participated in the murder of a trans teen to 8yrs. So you can literally KILL a LBGTQ and get less time than if you burned their flag. WTF?

This.
So much this!
How many times have we seen those who harm infants and children get far less time than this.
Dude needs a new attorney with a shit ton of experience in appellate court.

This country is going straight to hell in a hand basket. What the motherfuckin fuck.... Seriously? Rape a kid, probation-4 years. Burn a fag flag... 15..... Years???? Something very wrong here.... (I use the term "fag flag" as a term of endearment... So, you know. People dont get BUTTHURT.... Ugh.)

So fucking outrageous.

I don't know how the ACLU isnt taking up this case on freedom of speech grounds. You should be allowed to burn a flag to make a statement about a group you dislike. Not sure how that constitues a hate crime. It'd be different if he was actively trying to intimidate others by doing it, like he burned the flag near some gay persons lawn, something akin to racist cross burnings, but from the sounds of it he stole the flag and burned it elsewhere. Im not seeing how this is a crime at all other then misdemeanor theft for taking the flag and the no biggie arson shit.

It essentially is an arson fire that caused no significant damage to anything or anyone. But because the guy is a dumbass and made sure everyone knows he was trying to piss off some gays, it's 15 fucking years?

I have no sympathy for the dipshit. Society is no doubt better off with him removed from it. But still, outrageous sentencing.

Since your post was the first one, I'm going to reply to it, but it's really for everyone on the thread and @Turd Fergusen.

Burning an American flag is okay if you own it.
Burning a rainbow flag is okay if you own it.
Burning any flag at all is okay if you own it

Sneaking into a church and burning a flag that belongs to someone else is arson. Arson is a felony.

If you admit that you did it because you hate gays, then it's classified as a hate crime, triggering a provision related to his two previous felony convictions.

It was his two previous felony convictions that ultimately brought the maximum sentence up to fifteen years. The judge imposed the maximum sentence because Martinez showed no remorse, and had a history of violent behavior.

He's an habitual criminal.

He wasn't prosecuted for burning the LGBT banner (The church said it was a banner, NOT a flag)
If something seems whacky?
Question it, because there's probably a reasonable explanation that's being withheld from the readers.

The Fox article conveniently omitted the previous two felony convictions.
To mislead.
That's not the fault of @Turd Fergusen.

A little more than confusing.
Hate crimes are defined by law AR hate crime laws include crimes committed on the basis of the victim’s perceived or actual race, color, religion, national origin, sexual orientation, gender, gender identity, or disability.

The United States is a country, not a person.
A hate crime against the U. S. would would be under treason or an Act of War against us, terrorism maybe?

Anyway, that's the way the law is written, and it's to deter and punish acts of violence stemming from prejudice.

I mean, people that kill their wives, mother's? That's hate, but it's not based on an unfair generalization, or pre-judging of a person to have negative attributes.

He committed a Class B and a Class C Felony. He could have received 25 years, no hate attached.
This is his THIRD ARSON.
He said in court that the minute he gets out he'll do it again.

Again, it's NOT About the banner.
It's the verbal threats of burning the nightclub down to the ground and Lighting the material outside near the building. Arson.Nothing to do with the banner.

The title purposely misleads you into believing that. The title and the article which omits critical parts is MEANT to bring about this reaction. And even after I added the missing parts, there's access to the full, accurate articles out there, the Fox article, so biased it's horizontal, it still succeeded in... never mind. I'm tired.
