"The victim of a deadly shooting at a Merritt Island Walmart had gone to the store to confront a store manager over a relationship when the manager fired a gun during the dispute, Brevard County sheriff's investigators confirmed Monday.
Now investigators will turn the case over to the state attorney's office for further review following questions of whether the shooting was a matter of self-defense.
The shooting took place about 8:30 p.m. Sunday inside the grocery section, near the entrance of Walmart, 1500 East Merritt Island Causeway. Authorities said the worker, identified as 27-year-old Rashad Gibson, was in the store and used a gun to shoot Shawn Robbins during the confrontation. The men, both from Cocoa, had a dispute over a woman.
Brevard County sheriff's investigators were expected to attend the Brevard medical examiner autopsy on Robbins as they also review the circumstances leading up to the shooting.
Investigators were looking into reports that Robbins, described as unemployed, may have walked through the store searching for Gibson in several departments. It was not immediately known if Robbins was armed at the time the two men met or if Gibson had a permit to carry the handgun used in the shooting. According to state law, a person can use deadly force in self-defense if he or she is in imminent threat of death or bodily harm.
“(Robbins) was deceased on the scene...there is no danger to the community,” Tod Goodyear, spokesman for the Brevard County Sheriff’s Office, said at the scene Sunday night.
Investigators talked with Gibson but no arrest was made. He was also described as cooperating with the investigation."
