Braydon Pena and Shaniah Harris are accused of not checking on their 1-year-old baby for at least sixteen hours.

First Responders found the baby n a playpen, saying he showed obvious signs of death, such as stiffness and discoloration, indicating that he had been dead for hours. Po

The child also had scabbing on his face and leg. He also appeared to have not been bathed in awhile.

Harris informed responders that the baby had hydrocephalus.

According to documents, Pena told investigators that he woke up around 10 a.m. to get breakfast from a nearby fast food restaurant for Harris and himself and that they both went back to sleep after eating.

Pena said they checked in on the 1-year-old when they woke up around 6 p.m. because “it was odd and unusual that he would make no sounds and sleep that long,” documents said.

Based on the times the parents provided to police, the boy had not been checked on anywhere from 16 to nearly 20 hours.

Pena told police he has a history of drug use and wouldn’t say if he had taken drugs recently, documents said. Meanwhile, the baby’s mother, Harris, kept telling Pena not to talk with officers without a lawyer.
