"A Greensburg (PA) man was arrested by city police this week, charged with raping an unconscious woman after a party last month.

Emmanuel Lebbie, 24, was arraigned Tuesday on charges of rape of an unconscious victim and sexual assault in connection with the 6:52 a.m. Sept. 28 assault that police say occurred in an apartment along Alwine Avenue.

Lebbie was arraigned before District Judge Chris Flanigan and ordered held in the Westmoreland County Prison after failing to post $150,000 bond.

The victim told Det. Charles Irvin that she was drinking with acquaintances at a friend’s residence, but felt she had too many drinks and decided not to join them when they went to a nearby bar.

According to court documents, the victim said she went to sleep in her friend’s bedroom and woke up in the middle of an altercation between Lebbie and a male acquaintance.

“She awoke and found herself naked from the waist down,” Irvin said.

The male acquaintance told investigators that he returned to the apartment from the bar and was speaking with friends outside, but could not locate Lebbie, who had been seated on the couch when returning from the bar. The man told police that he found the bedroom door was locked and noise coming from inside.

The man told police that “he used a quarter to unlock the door … and saw (Lebbie) with his pants down and (the victim) unconscious and naked from the waist down,” Irvin said.

Irvin said an altercation ensued and Lebbie subsequently left the residence. The victim was taken to the hospital.

A preliminary hearing is scheduled Oct. 24 before Flanigan."

Defense attorney Owen Seman told jurors Lebbie continues to deny the rape allegations.

Seman, in his opening statement to the jury, did not address the potential presence of DNA evidence but suggested witness testimony was unreliable and questioned whether the woman was actually unconscious.

“There are a lot of gray areas and question marks about what happened. People’s recollection may not be as accurate as they want you to believe, and if she was unconscious, would she have been left alone?” Seman asked jurors.
