Woman tricked into sex with boyfriend’s pal exposes loophole in rape laws

An Indiana college student watched in horror as a creep who tricked her into having sex with him got off scot-free because of a legal loophole, she said in a new report.

Abigail Finney, 20, fell asleep in her boyfriend’s dorm room at Purdue University when she was a freshman last year and woke up feeling someone groping her from behind, she told Buzzfeed News.

She assumed it was her partner and they had sex. Finney said she never turned around to see his face and the room was dark. After a minute, Finney got up to go to the bathroom, she said, and came back to see her boyfriend’s friend, 19-year-old Donald Grant Ward, lying in the bed.

“I remember him grinning at me. It was a freaky image,” she told the site. “I was just kind of — I was frantic. I didn’t know what was going on.”

She assumed her boyfriend’s friends, who’d fallen asleep on the futon, were playing a prank on her and demanded to know where her boyfriend was. They said they didn’t know.

Finney rushed back to her room to find her boyfriend sleeping there and told him what happened. Angry and confused, he stormed out. Alone in her room, Finney wondered if she’d been raped or if what happened was against the law. She texted two friends for advice.

“I was like, ‘I feel violated. This feels wrong. But I don’t know if it’s illegal.'”

After Finney’s boyfriend confronted Ward, they went to the police, who conducted an investigation.

In an interrogation, Ward admitted he believed that Finney thought he was her boyfriend “because she got very close to me,” according to a Tippecanoe police affidavit. Cops charged him with two counts of rape in February 2017.

Despite that, what he did isn’t defined as rape under state law.

In Indiana, and 40 other states including New York, rape is legally defined as sex compelled through force or threats or if the victim can’t consent or is unaware that the sex is occurring. Consent isn’t expressly defined in the statute.

After two days of testimony and a few hours of deliberation, Ward was acquitted and the rape charge expunged from his record.

Finney began suffering anxiety and nightmares and had to take time off from school.

“I was pretty angry. I felt like I’d wasted a year of my life because I could’ve been trying to heal, but instead I was reopening the wound over and over again,” said Finney.

“My therapist even called the trial a second trauma, so I guess I felt like I had done all that for no reason.”

I'm confused. If consent isn't actually in the statute in 40+ states, then how have the tried half the rapes cases as of late? They've also been running consent campaigns trying to raise awareness of what consent is. Ironic as fuck that the American government shamed Germany for not having a no means no law when the immigrants were raping people and yet it turns out America doesn't actually have one either..

A sneaky lawyer could have maybe used the "can't consent" part. She couldn't consent if she didn't know it was the wrong person type deal. Use their loopholes against them.

I can understand how this is not a violation of the law, the way the law is written, but it is definitely a violation of the spirit of the law. I guess this is one of those cases where you have to hope for street justice.

Would be really funny if someone found a loophole in the Indiana assault laws...

Well I can see why he would have to rape a girl from behind God knows no woman is going to be willing to engage that freaking face.
The boyfriend needs to find a better class of friends to be hanging around with for starters. I would be inclined to actually put a bounty out on the guy and see if you can get some Frat Boys to go and teach him a few life lessons at the end of a baseball bat

OK, so like I had a pretty 'active' sex life during my college years, but um how large does ones hooha have to be to not realize the dick is different? NOT saying what he did was right but if you are chillin and some dude was able to slide it in the vajayjay (like did she have no pants on or chonies in a room full of peeps?) and you don't realize it's NOT your mans dick.....i mean they are not all the same. I have experience, I would know if Lil Man was hanging to the left instead of right or if he was a semi-softy vs a rock hard beast, I would notice it was better/worse than what I 'normally' was getting. And smell, like men smell so different, and Mr. RapeyPants seems like he'd smell like failed WoW Marathons, Hot Cheetos and shame.....and never once did she glance back to check 'who dis?' in that pussy? Agreed, which is why I said it wasn't right, just seems weird. She was drunk enough for a mystery bang but not so drunk she was able to get her boyfriend and call police immediately? Just saying the entire story seems odd.
