A Family Court commissioner ordered today that 3-year-old Cortez Bass live, at least, temporarily with his father.

That decision came after a brief, closed court hearing in Clayton.

Cortez has been in the custody of DFS since the weekend, when he was found wandering alone Saturday night at closing time at the St. Louis Mills Mall in Hazelwood. The boy's mother, Shameka Taylor, 28, of St. Louis, showed up at the police station Tuesday afternoon and was arrested on unrelated warrants for probation violation and stealing.

The boy's father has asked, at this point, not to be publicy identified so he and his son can have some time together without media interference, Braeske said.

Braeske said his client intends to seek permanent custody of Cortez, given the circumstances of the case, and he's confident he will succeed.

Update: Cortez's Mother gets 5 years in prison

The mother of a 3-year-old boy who was found wandering the St. Louis Mills shopping mall alone last month is on her way to prison for unrelated crimes.

Shameka Taylor could have gotten a sentence of 120 days and probable probation if she had shown up for her original sentencing date of Nov. 18, 2002, in the court of St. Louis County Circuit Judge Gary M. Gaertner Jr.

Because she was a fugitive for five years and three months, Taylor got a sentence from the judge of five years in prison for the four felonies she committed in December 2000.

The underlying case dates to Dec. 21, 2000, when Taylor and two other defendants, she later admitted, stole a teacher's purse from a classroom at St. Michael and St. George Episcopal Church in Clayton.

A Visa card from the purse was used within 30 minutes to make purchases at a discount store in Vinita Terrace.

Taylor's attorney worked out a plea agreement in which Taylor would get probation if she completed 120 days in custody without incident. Taylor pleaded guilty on one count of felony theft and three counts of forgery, then skipped her sentencing.

Rejecting pleas of leniency from Taylor, who apologized for being a no-show five years ago, her boyfriend, and two of her six children, Gaertner on Monday sentenced Taylor to five years in prison on each count, then ran the terms concurrently. No charges have been filed so far in the mall abandonment matter.
