A mother originally charged with murder in the death of a Lincoln County boy pleaded guilty and was sentenced on a lesser charge, while the mother’s boyfriend is scheduled for a jury trial in the child’s death and could still face the death penalty.

Two-year-old Braxton Danker of Wellston died May 13, 2018 from a subdural hematoma due to a beating, with cause of death listed as homicide, according to the medical examiner’s report.

The toddler’s mother, Judith Danker, 19, and her reported boyfriend, Khristian Martzall, 27, were both initially charged in May 2018 with murder in the first-degree, child abuse.

Braxton had significant injuries that were noted during the autopsy, including a subdural hemorrhage, old rib fractures, as well as numerous contusions and abrasions, the autopsy report shows.

Lincoln County prosecutors previously filed a Bill of Particulars to have a death penalty option, upon conviction, against the two charged in the child’s death.

At the time the charges were filed, then prosecutors reported this was one of the worst child abuse cases they had seen and that Braxton spent his last days of life suffering.

According to Lincoln County court records, Danker entered a guilty plea to a lesser charge involving child abuse with the state’s recommended plea bargain. She waived a pre-sentence investigation and was sentenced to 25 years with the Department of Corrections and she must serve 85 percent of that time, court records show.

District Attorney Allan Grubb confirms secretary, Asia Davis, has been fired after taking pictures of a dead 2-year-old, and then sending the photos to her best friend through Snapchat.

The photos were taken last year by the Medical Examiner’s Office after the death of Braxton Danker.

“These were six very morbid pictures of a child on an autopsy table,” said Grubb.

However, Braxton’s alleged murder and the evidence leak, took place before Grubb was in office. He assumed the title of district attorney in January, but said his investigator discovered Davis sent the messages in October.

“(Trinity Walls) Ms. Walls then recorded that from a different device, and it appears she held on to it for about six months, and then she decided, at some point in the past two or three weeks, to send that to the danker family,” said Grubb.

He added he cannot speculate on the timing of the release, but he said that those involved share family ties.

“The Danker family member she sent it to, and Ms. Walls share a father of a child.” Grubb said. “It appears she held on to it from October 2018, until sometime around April 25th of 2019.”

He said soon after that Davis was fired.

Now, Grubb wonders if this incident will impact the upcoming jury trial of Martzall, who is facing the death penalty.

“The stuff is out there. I wish it could be deleted. The family does not need to see these photos. The general public does not need to see these photos,” said Grubb.

The district attorney said this evidence leak appears to be an isolated incident.

At this point, no criminal charges have been filled.

News 9 reached out to Davis, who did apologize for the leak. She released the following statement:

“I would like to apologize to the family and the community. It was never my intent for any communication about this case to be made public.”

“The child was covered in numerous physical injuries,” First Assistant District Attorney Adam Panter. “He passed away soon after arriving at the hospital.”

Danker allegedly admitted to police she used objects to hit her son multiple times.

“We have multiple bruises, we have open sores, we have spots where the skin has been torn away,” Panter said. “There’s a possibility of charges coming down the line for failing to report the physical abuse to the child.”

An Oklahoma judge caught playing with her phone as a mother sobbed about the murder of her child faces a formal push to remove her from the bench after it emerged she sent 500 texts to her bailiff — including some ridiculing the prosecutors and calling the dead toddler’s mom “liar, liar.”
The chief justice of the Oklahoma Supreme Court recommended the removal of Lincoln County District Judge Traci Soderstrom in a court filing Tuesday following an investigation by the state’s Council on Judicial Complaints.

Soderstrom — who had only been sworn in as a judge in January — had been caught on surveillance footage in June constantly playing with her phone during Khristian Martzall’s trial for the murder of beaten 2-year-old Braxton Danker.
When the toddler’s mom, Judith Danker, took the stand as a key prosecution witness against Martzall, her boyfriend, Soderstrom texted: “Can I please scream ‘liar, liar?”

“State just couldn’t accept that a mom could kill their kid, so they went after the next person available,” one text said, according to the complaint board’s findings.
Soderstrom’s messages also questioned whether a juror was wearing a wig, if a witness has teeth — and inappropriately admiring a police officer who testified as “pretty.”

“I could look at him all day,” the judge texted about the unidentified officer.

The judge also repeatedly referred to District Attorney Adam Panter, saying he was “sweating through his coat” while questioning potential jurors — and asking, “Why does he have baby hands?”
Soderstrom also texted a laughing emoji to the bailiff, who “made a crass and demeaning reference to the prosecuting attorney’s genitals,” the filing states.

At one point, she also allegedly discussed sentencing with the bailiff, saying a second-degree manslaughter charge would only get Martzall two to four years behind bars.

“Ahhh. And he’s already served that,” the bailiff responded, to which Soderstrom simply replied, “Yes.”
In the end, Martzall was convicted of second-degree manslaughter for Danker’s 2018 death — and was sentenced to four years with credit for time served.

Danker, meanwhile, pleaded guilty to enabling child abuse and was sentenced to 25 years behind bars.
When questioned by the Council on Judicial Complaints, Soderstrom said her texting “probably could have waited” — saying she thought, “oh, that’s funny. Move on,” according to the filing.

However, Chief Justice John Kane IV wrote in the filing to remove her that her “pattern of conduct demonstrates [Soderstrom’s] gross neglect of duty, gross partiality” and “lack of temperament to serve as a judge.”
“The totality of the text messages give the appearance Respondent believed the defendant was innocent and that she wanted a particular outcome in the case,” Kane wrote.
Soderstrom has been temporarily suspended from her position since she was exposed for being on her phone during the trial.

Her attorney told The Oklahoman that she “takes these allegations very seriously” and is requesting “the entire record from the Council on Judicial Complaints so that she can respond appropriately.”

An Oklahoma judge has stepped down after she was caught sending hundreds of text messages while presiding over a murder trial concerning the death of a two-year-old boy.

Lincoln County District Judge Traci Soderstrom exchanged more than 500 texts with a bailiff in which she mocked prosecutors and witnesses, including the mother of the deceased toddler Braxton Danker, the Associated Press reported.

Khristian Martzall, the boyfriend of the child’s mother, was on trial and was later convicted of second-degree manslaughter.


The chief justice of the Oklahoma Supreme Court, Justice John Kane IV, recommended her removal from the bench in October over accusations of gross neglect of duty, lack of proper temperament, and other grounds, the AP reported.

The move to oust Soderstrom came about after the Oklahoman published 50 minutes of security footage, which showed Soderstrom sending messages for minutes while in the courtroom.

In Kane’s petition, he said that an investigation into her texts revealed she described the defense attorney as “awesome” and wanted to “clap for her.”

By contrast, she mocked a prosecutor for “sweating through his coat” and made fun of jurors’ hair and teeth.

She also texted a laughing emoji icon to the bailiff, who “made a crass and demeaning reference” to the prosecuting attorney's genitals.

When the deceased child’s mother took the stand as the prosecution’s key witness, she sent a text saying: “Can I please scream ‘liar, liar?'”

Other texts appeared to show the judge expressing her opinion that the defendant was innocent.

Soderstrom decided to step down before she was due to go on trial in a special court on Monday, per the AP.

The judge, who took office last year, said that she decided to step down rather than see out the trial because she did not believe it would be fair.

In a resignation statement published by local media, Soderstrom said that when she took office, she “promised to uphold the Constitution in a fair, even-handed and efficient manner.”

“In spite of resistance at nearly every turn, I believe that I have done so. However, being human, I have also faltered,” she said.

Not that it would be ok, but I can imagine this happening easier if she been on the bench for like 30 years and was just tired, jaded, and cynical from decades of listening to scum sucking liars and dealing with the dregs of society. But holy shit the dumb ass bitch literally-L I T E R A L L Y just got on the bench! What a complete and utter moron.
