Thomas Josiah Foster is charged in Burleigh County District Court with patronizing a minor for commercial sexual activity, a Class A felony.
Court records say a woman reported to Bismarck police last month that a man repeatedly requested through text messages to involve her daughter in sexual activity. The woman gave law enforcement permission to use her phone to communicate with the man.
The man, thinking he was messaging the mother, agreed to pay $300 to the woman if she transported the girl for sex. He also offered money for naked photos of the girl.
Investigators identified the man as Foster. The woman said she had met Foster twice over the course of two years.
Foster is being held in the Burleigh Morton County Detention Center in lieu of $150,000 cash bond. He did not have an attorney listed in court records.
