Injuries to the child include a broken leg bone, broken ribs, and two skull fractures. Head scans revealed two large pockets of fluid where the temporal lobes of the brain should be. Doctors told investigators “the voids appeared to be filled with blood and eroded brain matter,” according to court documents.

The parents told investigators that night they weren’t aware of the severe injuries or how their daughter got them. The Berrys agreed to undergo a polygraph test on July 24, as detectives attempted to understand how the child was so hurt.
Detectives wrote that during the polygraph, James Berry initially denied any knowledge or involvement in causing the injuries. However, as the interview progressed, James told police he wasn’t feeling his normal self about 10 days before while taking pain medications. He described going into a “blackout” state of frustration and anger as he struggled to hold the baby because of pain. He said he didn’t remember exactly what happened, other than he knew 'bad things happened to the baby.'

Eroded brain matter....so this poor little helpless baby is now basically going to be disabled for the rest of their life.

These "people" pretty much have sentenced this baby to a life of misery, of unspeakable pain and nothingness. I hope they get tried for something more than just endangering the baby's life or assault. They should be charged with attempted murder/murder.
 
The temporal lobe is responsible for sooo much of everyday life. Even the slightest damage can have drastic effects. It handles vision, memory, sensory input, language, emotion, and comprehension. People with temporal lobe damage are prone to extreme aggression.

Chances are high this baby will never have even a semblance of a normal life but because the baby lived, they will receive only a slap on the hand.

Police interviewed a pediatrician who had examined the infant two days before she was hospitalized. The pediatrician said several of the injuries found on the victim had not been present before. The pediatrician had expressed concern about the competence of the parents after they missed an appointment and because the baby was underweight. She warned them she would contact Child Protective Services if they missed another appointment.

After the couple admitted to the abuse, a social worker filed paperwork to declare the child in “imminent danger.” The child has been removed from the Berrys’ custody and they are not allowed to have contact with her, according to the police report. The victim’s medical decisions have fallen to the Idaho Department of Health and Welfare.

I am pissed that the doctor gave them a warning instead of just reporting them.

It is possible that baby would have been saved from having her life permanently altered.

I will be optimistic that the state will do right by this child and protect her but she will forever be at risk of being further abused if she is placed in a foster or long term care facility.

The parents were subsequently charged with felony injury to child with infliction of great bodily injury enhancements.

James and Amanda Berry reached plea agreements this morning with the Bonneville County Prosecutor’s Office. The couple pleaded guilty to two felony counts of injury to child in exchange for a dismissal of the felony enhancement.

The two entered the plea agreements as part of Alford Pleas, meaning they assert their innocence but agree there could be enough evidence for a jury to convict him.

According to court documents, when the Berrys took the baby girl to EIRMC, medical staff told investigators the newborn was under her birth weight and had many fresh and old injuries. Her leg and ribs were broken and she had two skull fractures. Head scans also showed two large pockets of fluid where the temporal lobes of the brain should’ve been, according to court documents.

Doctors told detectives “the voids appeared to be filled with blood and eroded brain matter,” according to court documents.

Initially, both parents denied any involvement in the baby’s injuries; however, during follow up interviews, both James and Amanda Berry said they experienced blackouts and were rough when handling her.

While at the hospital, the child suffered persistent seizures, prompting doctors to place her into a medically induced coma. After about two weeks, the child was stabilized and CPS took custody of the baby, putting her into a foster home.

As the case involves a child, the baby’s current condition remains unknown.

Sentencing for Amanda Berry is set to happen on Jan. 25, 2021. James is set for his change of plea hearing on Sept. 1.

Unknown my ass. Maybe unreported, but not unknown. Through the magical powers of deduction, we can know things that we wouldn't otherwise! It's almost like a crystal ball, just, without the crystal ball.

The child's brain damaged. I would guess horribly and irreversibly so, and if it lives long enough, it will live life as a profoundly handicapped person.

An Idaho Falls couple was sent to prison on Monday for the horrific abuse that eroded the brain of their six-week-old infant.

James A. Berry, 23, and Amanda L Berry, 24, were ordered to spend five and a half to 15 years in prison and four to 14 years in prison, respectively. The Berrys pleaded guilty to two felony counts of injury to a child after Amanda Berry took their unresponsive 6-week-old daughter to Eastern Idaho Regional Medical Center in July 2019 with no plausible explanation of the infant’s severe injuries.

“It is a miracle baby,” Watkins said. “In this case, these offenses would have changed dramatically had this child lost a life. We know that was very possible as we understand the extent of the injuries.”

“I would first like to say while I did not know my child’s bones was (sic) broken, I wish I could take it back every day,” Amanda Berry said before Watkins sentenced her. “I wish it had never happened, and I’m really sorry.”

James Berry said he did not know what to say when asked by Watkins if he had any statement.

After about two weeks, the child was stabilized, and Child Protective Services took custody and placed her in a foster home. The child remains with a foster family and still struggles day to day. She likely will require help for the rest of her life.

“It’s not all bad news,” Spencer said.

While in her recovery, the child has been able to gain the ability to use both arms, sit up on her own and eat better than before. He said medical professionals are hopeful the child might be able to walk in the future. Spencer said the child’s eyes can see, but her brain cannot process the information yet because of the damage done.

“They are also hopeful that maybe with time, the pathways that allow for that to happen will heal or be reformed,” Spencer said. “She’s not normal for a baby at a year and a half, but they hope that maybe someday she will be able to do some things for herself.”

Spencer asked Watkins to sentence James Berry five to 15 years in prison and Amanda Berry to four to 15 years in prison. He said the biggest mitigating factor for the mother was her taking the child to EIRMC, which likely saved the young girl’s life. James Berry’s attorney, Neal Randall, asked he be sentenced one to six years in prison. Rocky Wixom, Amanda Berry’s attorney, asked she be sentenced one to 10 years in prison

In addition to the time in prison, the Berrys were each ordered to pay $2,000 in fines.
