A Florida girl died when her 325-pound cousin allegedly sat on her as a form of punishment, according to authorities. Veronica Green Posey, 64, has been charged with homicide and cruelty towards a child, an arrest report revealed.

According to WXIA, paramedics responded to a report of a cardiac arrest. The nine-year-old Dericka Lindsay was found unresponsive and was taken to Baptist Hospital, where she was declared dead.

Posey told a sheriff's deputy that she sat on Dericka as punishment "for being out of control".

While sitting on her, Posey said the girl told adults that she could not breathe. When Posey stood up, she discovered the girl was unresponsive, called 911 and began CPR.

Two other adults, 62-year-old James Edmund Smith and 69-year-old Grace Joan Smith, were also arrested and charged with child neglect for failing to report the abuse. Grace Joan was additionally charged with cruelty toward a child, WXIA reported.

The Smiths were Dericka's parents and Posey's aunt and uncle, the report stated.

She told the deputy that Posey first struck the girl with a ruler and a metal pipe, before Dericka ran to an armchair, according to WXIA.

The family had previous contact with the state's child welfare system, Mike Carroll, the secretary of the Florida Department of Children and Families told the Pensacola News Journal.

Posey's bond was set at $125,000 and she was released, Escambia County's jail records reveal. Meanwhile, Grace Smith's and James Smith's bonds were set at $75,000 and $50,000 respectively. They both remain in jail, the Pensacola News Journal reported.

Police reports detailing the conditions of Dericka's home life starkly contrast with the face she put on for everyone else. Deputies were called to her home multiple times in the 18 months before Dericka died last month after her 325-pound adult cousin sat on her as a form of punishment.

An Escambia County Sheriff's Office deputy responded to Dericka's Bryant Road home in June after Dericka and her little sister ran away. The responding deputy noted the girls shared a stained-brown mattress without any bedding, and they didn't have air-conditioning.

When the deputy found the girls at a friends' house soon after, they cried.

"(The girls) did not give me any specific reasons as to why they did not want to go home, but just kept crying and begged us not to take them back," the report reads.

Four months later, ECSO was back at the home to arrest Dericka's adoptive parents, Grace and James Smith, and the girl's cousin, Veronica Posey, in connection to the child's murder.

Arrest reports state Dericka was "out of control" on Oct. 14 when Grace Smith called Posey to come to the house and help discipline the girl. Grace Smith told deputies she saw Posey hit Dericka with a metal pipe before the child ran to an armchair.

Posey, a 325-pound woman, then allegedly sat on Dericka for more than six minutes until the child was unresponsive. She died at the hospital.

The state has upgraded the charges of the two alleged accomplices in a child's death after her 325-pound cousin sat on her until she died.

James and Grace Smith both appeared for arraignment in Escambia County court Wednesday in the death of Dericka Lindsay, 9, in October.

The state claims Dericka's cousin, Veronica Posey, 64, sat on the child as punishment for "being out of control." Dericka allegedly said she couldn't breathe, and when Posey stood up, the child was unresponsive. The state claims both James Smith, 62, and Grace Smith, 69, failed to act to save the child and were abusive on other occasions. The Smiths, who are related to Dericka, were the girl's adoptive parents.

A local human rights activist is hoping to find a better medical option than county jail for an elderly, ailing Pensacola woman.

Grace Joan Smith, 69, was arrested in connection with the death of her 9-year-old adopted daughter, Dericka Lindsay, on Oct. 14. Police reports allege Dericka died after her cousin, 325-pound Veronica Posey, sat on her for several minutes to control her behavior.

Smith — who was allegedly present but did not intervene — was charged with aggravated manslaughter of a child, child abuse and child neglect for her alleged role in the incident.

During her jail stay, Smith's health has deteriorated to a point that she requires nearly around-the-clock medical care, according to Ellison Bennett, spokesman for the National Movement for Civil and Human Rights.

Bennett said the county jail is not outfitted with the proper equipment, staffing or budget to give Smith the care she needs. A judge has cleared Smith to be transferred to a nursing home, but no local nursing home has been willing to accept Smith because of her pending criminal charges, according to Bennett.

"No one is excusing the child’s death, but this lady is in bad shape and we’re just pleading for help," Bennett said.

Bennett said he has been partnering with the county to advocate for Smith, and he said he hoped raising awareness of the issue might lead to a nursing home or hospice admitting Smith to its care. He said he had not been in direct contact with Smith, but his understanding is that she is bedridden and suffers from kidney failure and numerous other maladies.

In mid-December, Smith's publicly appointed defense counsel successfully petitioned a judge to reduce Smith's bond on the grounds that she required "immediate medical attention that may only be provided by a nursing facility."

Bennett said he understood people may not be sympathetic to Smith, but he said it was a tragic situation.

"For the child who lost her life and the people who have been charged with a crime, it's just a bad situation all around," Bennett said.

A nine year old and her little sister ran away, called the cops, begged for help, and were returned home to have one die. How trusting do you think the baby sister will ever be now? Let me tell you since except for death this has happened to me.

Zero. She has zero trust now.

A Pensacola man has been sentenced to 10 years in prison for his role in the death of a 9-year-old girl who passed away after being sat on by her 325-pound cousin as a form of "discipline."

James Edmond Smith, 64, pleaded no contest to one count of aggravated manslaughter in the October 2017 death of his adopted daughter, Dericka Lindsay.

According to investigators, James and Grace Smith called their niece, Veronica Posey, to their Bryant Road home to assist them in disciplining Dericka. According to a news release from the State Attorney's Office, in the course of the punishment, Posey sat on the child for almost 10 minutes.

Consequently, the child died from mechanical asphyxia, or a lack of oxygen.

Grace Smith’s case is pending, though her competency for trial — her ability to understand court proceedings and provide assistance to her attorneys — is in dispute. She reportedly also has severe health issues that prompted social advocates to petition for her to be released from jail into a hospice.

Sheriff's deputies made multiple visits to the Smiths' home in the 18 months leading up to Dericka's death. The 9-year-old reportedly ran away on multiple occasions, and cried when she had to be taken back home.

A deputy responding to one incident wrote Dericka and her sister shared a stained-brown mattress without bedding and that there was no air-conditioning in the home.

Dericka's friends and others who knew her described her as a cheerful, loving girl whose demeanor didn't reveal her troubled home life.

A Florida woman has been sentenced to life in prison for killing her 9-year-old cousin sitting on her as a form of punishment.

The Pensacola News Journal reports that 66-year-old Veronica Green Posey was sentenced Friday after jurors convicted her of first-degree felony murder.

Prosecutors say Dericka Lindsay had suffered horrific beatings from Posey, and Lindsay's adoptive parents, James and Grace Smith.

James Smith was previously sentenced to 10 years for his role in Dericka's death. Grace Smith still faces charges but is currently mentally and physically unfit to stand trial.

A jury heard the schoolgirl died of suffocation after she was starved of oxygen when 320lbs Posey crushed her in an effort to get her under control in October 2017.

Prosecutors say little Lindsay had suffered horrific beatings from Posey, as well as from her adoptive parents, James and Grace Smith.

Posey's attorney said the 320-pound woman was trying to help the Smiths and didn't intend to hurt Dericka.

In an autopsy, the medical examiner found Dericka had severe bruising on her buttocks that she described as 'injury, on top of injury, on top of injury.'

Assistant State Attorney Amy Shea said on the day of Dericka's death, Posey was awoken by a phone call from Grace Smith saying that Dericka and her eight-year-old sister were misbehaving.

'Once her feet hit the floor getting out of bed, she was determined to beat these children,' Shea said.

She took a ruler and a thin pipe intended to give the ruler 'weight,' then went over to the Smiths' home to aid Grace Smith with the beating of the young child.

Posey forced the girl to bend over arm armchair and then sat on her back, crushing her chest.

Despite the girl's screams that she couldn't breathe, Posey continued to sit on her until she stopped moving. It was only when she realised the girl had stopped breathing that she called 911.

At the time Posey told law enforcement that she sat on the small girl 'for being out of control.'
