A Texas man received the maximum sentence for child pornography Thursday after initially blaming West Nile virus for his actions.

Irving Jose Marquez, 30, was sentenced to 20 years in prison and a lifetime of supervised release after he pleaded guilty to a federal charge of receipt and distribution of a visual depiction involving sexual exploitation of a minor.

Marquez’s lawyer had asked the judge to give his client the minimum sentence of five years, but the judge declined.

Marquez’s lawyer John Calhoun, had argued that he had contracted the West Nile virus in 2009 and the brain damage he received from it made him sexually aggressive.

“It wasn’t him who did it, he didn’t ask for West Nile,” Calhoun told the judge during the sentencing, according to the newspaper. “Because of the mental and emotional conditions of Mr. Marquez, he deserves a variance of the 20 years …The government is asking for 20 years, we are asking for five years and extensive supervised release.”

A judge argued that the sentence was what’s needed to “protect the public.”

U.S. Homeland Security investigators were tipped off in 2017 about possible child pornography on a Flickr account under Marquez’s name. Investigators found hundreds of illicit images and videos of young girls he knew on multiple electronic devices owned by Marquez, according to El Paso Times.

Prosecutors said Marquez was “entirely responsible” for setting up a camera at a mall restroom.

This attorney needs to be socked right in the dick.
 
Now, I'm not saying this guy doesn't deserve this punishment, but he got 20 years for hiding a camera in a public restroom and recording underage girls and whatnot. 20 years. (as far as I'm reading, he didn't actually touch anyone). again - not arguing against his punishment. but compare that to this guy:

There's only one way to cure this West Nile Virus thing. He must immediately be infected with the Ebola virus. Ebola will kill off all effects of the West Nile Virus. No mind you it kills the host as well but in this case that's kind of a bonus don't you all agree?

Not saying this should be a thing but you asked why so I shall answer.

Rape, even of a minor, generally doesn't raise to federal levels. And because she was 14 it's not pedophilia. He gets around the same sentence he would for raping a full grown women with maybe a few years tacked on for being her guardian. He also had 30 people stand up and vouch for his character.

The picture dude in this thread violated federal law and had federal charges against him. Its the distribution charge that really fucked him over. They do not take kindly to people making or distributing CP and will throw the book at them. They can go as far as tacking on a charge for every view they can prove the picture got. He would have gotten far less if he was viewing CP someone else made vs making his own. This guy had pictures and video of children under 12, and has a history of being sexually aggressive since the age of 10. His own mother testified against him. This article left out that he was also deemed a danger to society, should he ever be released and reoffened he goes away for life.
