TAZEWELL, Va. — A Tazewell County man has been arrested on charges of child abuse and more charges relating to the incident could be pending.

Richard Riffe, 39, of Falls Mills, has been charged with a Class 6 felony for causing “a child to be tortured, tormented, beaten or cruelly treated,â€￾ according to a statement issued Monday morning by the Tazewell County Sheriff’s Office. The Virginia Department of Social Services and officials with Tazewell County Public Schools assisted in the case.

Riffe is presently being held at the Southwest Regional Jail in Tazewell.

Felony in West Virginia

Some West Virginia felony convictions—Class 3 and 4—may be served in a jail facility at the discretion of the jury and the judge, but most mean prison time. The four most severe classifications may include a fine of up to 100,000 dollars:
◦A Class 1 felony—the most severe classification—is punished by death or life imprisonment and includes such crimes as murder by poison and premeditated killing.
◦A Class 2 felony is punished by up to 25 years in prison.
◦A Class 3 felony in West Virginia means a 5 to 25 year sentence.
◦A Class 4 felony is punishable by two to ten years in prison.

The final two lesser felony classifications may include a fine of up to 2,500 dollars, but they differ in length of imprisonment:
◦Class 5 felonies are punished with a one-to-ten year sentence in a state prison or 12 months maximum in a county jail.
◦Class 6 felonies are punished with a one-to-five year sentence in a state prison or 12 months maximum in a county jail.
