NEW ROCHELLE, N.Y. (AP) - Police say a 30-year-old man killed his toddler son by slamming his skull against a hard surface.

Detective Capt. Joseph Schaller said Thursday that Richard Leak of New Rochelle was charged with murder in the Sunday death of 2-year-old Khalil Leak.

He says the Westchester County medical examiner had determined the cause of death to be a fractured skull caused by blunt force.

Police say they found the boy dead after Leak called Khalil's mother and reported he was having trouble breathing.

Schaller said Khalil Leak's mother, Richard Leak's live-in girlfriend, was at the hospital because the child's younger brother was having respiratory problems. He also said the initial report was that Khalil Leak had fallen off the sofa and hit his head on the floor.

The girlfriend called a neighbor to check on the 2-year-old. Not 911? Or tell him to do it???

The child was taken to Sound Shore Medical Center and was pronounced dead around 2 a.m.

Schaller said Khalil Leak was removed from his father's custody to a foster home in February 2009. At the time, the child was taken to Sound Shore Medical Center with fractured ribs and a broken leg, he said. The child was returned to Richard Leak in June 2010.

Richard Leak has a prior criminal record, Schaller said: burglary, possession of a controlled substance and assault. He said the assault charge, which involved an adult, netted Leak a one-year sentence in jail.

Schaller said the mother is not facing any charges and the surviving younger child is in a foster home.

The DA's office said Richard Leak faces a maximum of 25 years to life in prison if convicted.

Okay, this one statement confuses me about the situation:

"Schaller said the mother is not facing any charges and the surviving younger child is in a foster home."

So, was the younger sibling she was at the hospital with HIS biological son, and not hers?
Because, usually, if the other biological parent isn't charged with abuse AND the abusive parent is out of the house (jailed)....
doesn't the surviving child stay in the home?

Otherwise, if the baby IS hers, and they took him into foster-care because she knew about (and was helping to cover-up) prior abuse of the murdered 2 year old, I would hope that the DA would charge her criminally, not JUST remove her surviving son!
 
Did the mother call the neighbor because she already knew Khalil was hurt, or did she remember she'd left one of her babies alone with an abusive douche and get worried history would repeat itself?

Maybe what they're not reporting here is that the younger child, already being taken to the hospital by his mom, was hurt by this POS father, too. "Trouble breathing; respiratory problems." If his injury is being investigated, they would take the child from her during the investigation in view of the older child also being injured. How much did she know? Was she there when it happened? Are these injuries related?
 
A New Rochelle man was convicted by a Westchester County jury Monday of killing his 2-year-old son, who was found with a fractured skull and ribs in January 2011.

Prosecutors said Richard Leak, 32, had slammed his son, Khalil Leak, against a hard surface with such force that it was like a car crash.

The defense said the injury was an accident and jurors, who found Leak not guilty of murder, appeared to buy at least some of that argument. He was convicted of manslaughter.
