How do they know he left her there while she was ODing? He might have supplied the drug but was he with her when she took it? Was it instant or did it bowl her over later? Maybe someone else gave her more?
To get this conviction they would need solid evidence that he was with her when she started overdosing, that he knew that was what was happening and decided to walk away.
