A New York family is being countersued by the nursing home that was blamed for the death of their family member.

The New York Post reports a jury awarded $1 million to the family of Salvatore Niosi after a nurse at the Woodhaven Care Center in Long Island forgot to put his dentures in and fed him a sandwich, causing him to choke to death.

News 12 Long Island reports Niosi's daughter, Silvia Teixeira, filed a wrongful death lawsuit against the nursing home after discovering that her father's chart specified he was only to be fed pureed food. Surveillance video showed a nurse failing to check Niosi's chart before feeding him the sandwich.

"He deserved better," Teixeira said. "He deserved a different ending to his story."

Niosi died within minutes but it took half an hour for anyone at the facility to call 911.

The nursing home accepted responsibility for the man's death, but is now countersuing, claiming the family owes the center money for Niosi's stay.

"It's a slap in the face. They did wrong. You know, they know they did wrong and it's like they're benefiting from his death. It's like somebody murdering somebody and then asking for money," Teixeira said.
 
Yeah... sue the family of the man killed by one of your employees by negligence. That ought to be really good for business, no way that could blow up in your face.
