PHOENIX — A newborn is dead after being found in a trash can inside of a restroom at an Amazon distribution center in Phoenix on Wednesday evening.

According to Phoenix police, the incident was reported at the facility near 51st Avenue and Lower Buckeye Road around 8:30 p.m.

Police say the baby was beyond resuscitation when first responders arrived at the scene.

Police said the warehouse remained in operation while officers were on scene.

Officials say they have located the mother and have spoken with her. She is not being identified at this time.

Arizona has a Safe Haven Law, allowing for the safe hand-off of babies up to three days old. According to the Safe Haven site:

"You can leave your baby, up to 3 days old, with an on duty staff member at any hospital, emergency medical service provider, fire station or with any licensed private child welfare agency, licensed adoption agency or any church in Arizona."

Some hospitals also have special drawers to leave babies without having to speak with anyone.

Police say a woman has been arrested on suspicion of unlawful disposal of human remains after her newborn baby was found dead inside an Amazon distribution center in southwest Phoenix last week.

They say 22-year-old Samantha Vivier was booked into jail Tuesday.

CBS station KPHO reported Vivier told police she did not know she was pregnant.

Police say the body of a baby girl was discovered the night of Jan. 16 inside the women's restroom in the secured Amazon facility.

Officials say the baby was full-term or near full-term and the Maricopa County medical examiner will determine the cause of death.

An Arizona woman whose newborn girl was found dead last week in the bathroom of an Amazon distribution center told cops she didn’t know she was pregnant and “panicked” after giving birth, according to local reports.

The Amazon worker told cops she had gained 15 pounds recently but never felt a baby move, and hadn’t gone to see a doctor in the past year, according to court documents obtained by AZ Central.

When she gave birth around 11:30 a.m., on her lunch break, she said the baby wasn’t breathing or moving and she told cops she was “confident” it was stillborn. She stayed in the stall for an “extended period of time” before another employee gave her paper towels and a plastic bag to clean up blood on the floor.

Vivier said she put the baby in the trash so that it wouldn’t be found and “to hide the birth from the father of the baby.” She then called a friend who gave her a ride home.

At about 8 p.m., a janitor changing a trash bag noticed it was “heavier than usual” and peeked inside to find an infant’s head. The baby was “unresponsive” and “cold to the touch,” the records said.

A witness told cops Vivier had been sick in the restroom for two hours and needed new pants. Vivier confirmed to cops that she’d given birth and paramedics were sent to her location.

During Vivier’s initial court appearance Tuesday, prosecutors said they do believe that the baby was stillborn, but that a medical examiner will determine the exact cause of death.

At least she didn’t kill the baby.
