Child abuse charges against five adults (WRONG! It's 3!) found living on a filthy compound with 11 starving children in Taos County were dropped Wednesday.

Lucas Morton, Subhannah Wahhaj and Hujrah Wahhaj were released from jail Wednesday evening.

Lucas Morton can't have any guns or alcohol and must stay in Taos County. Subhannah Wahhaj must stay in Taos County, can’t break any laws and must appear in court. Her sister, Hujrah doesn't have any special conditions, once she's released she can go anywhere.

Siraj Ibn Wahhaj and Jany Leveille will remain behind bars on additional child abuse charges in connection with the death of 3-year-old Abdul-Ghani Wahhaj. A no-bond hearing will be held Sept. 4.

On Wednesday, two different Taos County judges called out the district attorney's office for not doing what they were supposed to do, which led to the original charges being dismissed.

The judges said the state violated the 10-day rule for a preliminary hearing.

Suspects in custody have the right to a preliminary hearing within 10 days of those charges being filed.

The judges said prosecutors didn't try to schedule a preliminary hearing during that time or ask for an extension.

TAOS, N.M. (Reuters) - Five residents of a New Mexico compound were arrested on Friday by the FBI for violating firearms and conspiracy laws in what one of their lawyers described as a “bad development” for the group, who are accused of planning anti-government attacks.

A federal grand jury in New Mexico on Tuesday returned indictments on federal firearms and conspiracy charges against five people arrested after authorities allegedly found 11 hungry children and the body of another boy at a makeshift compound last month.

Federal prosecutors said in a criminal complaint that the five charged had a "common plan to prepare for violent attacks on government, military, educational, and financial institutions" as part of one of the defendant’s religious prophecies.

Siraj Ibn Wahhaj, 40; Jany Leveille, 35; Hujrah Wahhaj, 37; Subhanah Wahhaj, 35; and Lucas Morton, 40, are charged with one federal count each of conspiracy to provide a person unlawfully in the United States with firearms and ammunition, the U.S. Attorney's Office for the District of New Mexico said.

The indictment also charges Leveille — who authorities have said is a native of Haiti living unlawfully in the United States — with possession of firearms and ammunition.

Federal prosecutors say in court documents that the five charged established a training camp and firing range to prepare for attacks, and that Leveille and Siraj Wahhaj sought to train people, including children, to "be prepared to engage in jihad" and "die as martyrs."

Claims that at least once child was being training to commit school shootings have been alluded to in the past, and a local judge in denying that some of the five be held without bail said that prosecutors had alleged "there was a big plan afoot," but didn’t provide evidence to the judge’s satisfaction about what it was.

All five are scheduled to appear in court on Wednesday when they are expected be arraigned. Public defenders will likely be appointed.

A different local judge dropped child neglect charges against the five in late August because local prosecutors missed a deadline, and charges relating to the death of the boy were dropped so that the district attorney’s office could bring those counts to a grand jury. But on Aug. 31, all five were arrested on federal charges.

A federal grand jury in Albuquerque then returned the indictments Tuesday.

Here's 'Snopes' trying to put a 'false' spin on the 'nasty rumors about links to the DNC'.

The article is correct in stating that Imam Wahhaj is the father of Siraj Ibn Wahhaj, who was one of the five arrested in New Mexico and is under investigation in the death of an unidentified child whose body was found on the compound. The imam acknowledged their relationship (as well as his familial connections to the other four suspects) during a press conference one week after the arrests.

However, the claim that Wahhaj was the keynote speaker at the 2012 Democratic National Convention, and therefore somehow connected to Obama, is false, basically a regurgitation of a years-old, politically-motivated Internet rumor. Wahhaj neither participated in nor spoke at that convention.

I interviewed Dr. M Zuhdi Jasser in January and July of 2017 on Islamism and what he believes is its antidote, the Muslim reform movement. This is a follow-up interview.
Jasser is president and founder of the American Islamic Forum for Democracy (AIFD), co-founder of the Muslim reform movement (MRM), and author of “A Battle for the Soul of Islam: An American Muslim Patriot’s Fight to Save His Faith.” He is a practicing Muslim.

Postal: But to date, it doesn’t appear that Wahhaj Sr. was involved with the compound. So why is the connection to Wahhaj Sr. important?

Jasser: This case and what happened with the younger generation of the Wahhaj family will likely demonstrate the pathways of how American Muslims are often radicalized.

Granted, there is no evidence that the senior Siraj Wahhaj had anything to do with the New Mexico compound and his children’s jihadi terror training camp. In a Facebook video the day after the story broke, he stated that he “want[ed] to find out what happened, what made [his] children act in such a dramatic way.” I believe that his non-violent Islamist preaching spawned the separatist, violent Islamism that we saw in the New Mexico compound.


Siraj Wahhaj Sr.’s sordid history of association with radical Islamism is well known. I have been calling for the ostracization of Siraj Wahhaj Sr. since I personally publicly called him out in the one and only meeting of the Islamic Society of North America I had the misfortune of attending in 1995. At that meeting, I stood up and protested after he seditiously called for Muslims to actively seek the replacement of the “godless” man-made Constitution with the Qur’an. I described this in depth in my 2012 book, “A Battle for the Soul of Islam.”

He is a leading fundraiser and preacher for major American Islamist organizations like the Council on American-Islamic Relations, the Islamic Circle of North America, the Muslim American Society, and the Islamic Society of North America. The head of the American Muslim Council, the organization that invited him to give the first Muslim invocation to the U.S. Congress in 1991, is still serving time for trafficking over $300,000 cash from Libyan dictator Gaddafi in a plot to assassinate then Saudi Crown Prince Abdullah in addition to other terror finance charges.

Since the New Mexico jihadi compound story broke, the mainstream media has gone to great lengths to avoid any in-depth coverage of this story. I believe the mainstream media is protecting the senior Wahhaj’s reputation as well as that of the major network of organizations to which he is tied. Had Siraj Wahhaj Sr. not been related to this story, the coverage would have been very different.

Postal: What should Americans learn from the New Mexico case?


Jasser: I believe the American Muslim community is at a defining moment. How American Muslims learn and respond to the slippery slope of non-violent Islamism and its inherent separatism, as evidenced in the Wahhaj family, is critical. Will we remain in hopeless denial of the evils of Islamism? Will we as a diverse ideological community continue to allow the Islamist “establishment” to dominate and oppress our communities? Or will we finally garner the strength to stand up to Islamism and its separatism?

The Wahhaj family patriarch planted the seeds of Islamist separatism for decades. His hateful rhetoric spreads both within his family and in leadership positions throughout our communities. We can stay silent and enable this radicalization process, or we can fight with every fiber of our being against Islamist brainwashing.

Prosecutors have argued the accused adults trained children in the use of firearms at the rural compound and should remain in custody pending trial. In addition, a missing Georgia boy died during a religious ritual intended to cast out demonic spirits from his body, and his remains were kept on the compound, according to prosecutors.

New Mexico compound suspects were on a violent mission, prosecutors say. But the defense sees it differently.
But an attorney for one suspect said they were following religious rituals that might be viewed differently if they were white Christians rather than black Muslims.

The little boy who died did not merely "die during a religious ritual". He had very significant medical issues and was very fragile. His father kidnapped him and took him thousands of miles away to the harsh conditions of the desert compound with no running water or electricity and very little food. He also stopped all his needed medications and treatments and instead performed a ritual to eliminate the "demons" he thought were causing his son's medical issues. That is MANSLAUGHTER at the very least.

And if it were white Christians who did this, I would feel exactly the same and want the same punishment.
 
The couple behind the New Mexico cult that left a three-year-old boy dead and allegedly trained 11 children with an intention to carry out terrorist attacks, started their desert compound because of jealousy and 'black magic', according to authorities.

A federal filing claims husband Siraj Ibn Wahhaj and his first wife Jany Leveille ran off with his son Abdul-Ghani after Leveille became convinced Wahhaj's second wife, Hakima Ramzi, had used black magic to get pregnant with the little boy.

Court papers state that Leveille had suffered a miscarriage and thought Ramzi – who Wahhaj was also married to and openly enjoyed a polygamous relationship with – transferred the baby she lost 'from Jany into (Ramzi's) womb'.

The child was born with a disease called hypoxic-ischemic encephalopathy (HIE) due to lack of oxygen during labor and Leveille's brother, Von-Chelet Leveille, believes they were trying to make him better at the compound.

He says his sister, 35, used ruqya, an Islamic ritual which wards off evil spirits, but denies she used black magic.

'In Islam, having seizures can also be viewed as being possessed by spirits,' he told the New York Daily News, noting that the child had seizures once or twice a month.

'We stayed in contact for the entire nine months. I am one hundred percent sure they tried to heal him (Abdul-Ghani).'

Wahhaj's family believed his first wife – who he met a few years after she moved from Haiti to Brooklyn undocumented in 1998 - was suffering from schizophrenia and jealousy.

Update: Feds Indict 5 New Mexico Compound Residents On Terror And Gun Charge
A federal grand jury in Albuquerque has indicted five residents of a rural New Mexico compound on new terror-related charges connected to an alleged conspiracy to attack FBI and military personnel.

The five defendants were arrested last year after authorities found 11 malnourished children living in squalor in the small community of Amalia, near the New Mexico-Colorado border. They also discovered a large cache of weapons, leading to charges of conspiracy and illegal possession of firearms.

The superseding indictment announced Thursday charges Jany Leveille, 36; Siraj Ibn Wahhaj, 40; Hujrah Wahhaj, 38; Subhanah Wahhaj, 36; and Lucas Morton, 41; with a conspiracy to provide material support for terrorist attacks on federal officers and employees.

"The indictment alleges that the defendants conspired to provide material support in preparation for violent attacks against federal law enforcement officers and members of the military," said Assistant Attorney General John C. Demers in a statement. "Advancing beliefs through terror and violence has no place in America, and the National Security Division continues to make protecting against terrorism its top priority."


Attorneys for the defendants withheld comment, saying that they are waiting for more information from the government.

"We still don't have all the documents from the government regarding this case," said Amy Sirignano, who represents Morton, as quoted by the Associated Press.

Sirignano said in an email sent to the AP on behalf of the defense that their clients would plead not guilty when they are arraigned next week.

Four of the compound residents also are charged with kidnapping a child who later died. The remains of a small child were discovered three days after the initial raid. The boy, three-year-old Abdul-Ghani Wahhaj, was the son of defendant Siraj Ib Wahaj and had been reported missing from his home in Georgia since December 2017. The search for the child led the FBI to begin monitoring the group and to the eventual raid.

New Mexico state child abuse charges were dismissed last year when prosecutors mishandled the case.

"Federal prosecutors say that between Dec. 2017 and August 2018, the group, who are either siblings or related by marriage, had 'a common plan to prepare for violent attacks on government, military, educational and financial institutions,'" NPR's Vanessa Romo reported in September 2018.

The Justice Department statement laid out the allegations related to preparations for attacks against federal officers and employees:

"According to the superseding indictment, Siraj Ibn Wahhaj and Hujrah Wahhaj gathered firearms and ammunition, and all of the defendants transported people, firearms, and ammunition across state lines and constructed a training compound where they stored firearms and ammunition. The superseding indictment further alleges that Siraj Ibn Wahhaj and Morton constructed and maintained a firing range at the compound where they engaged in firearms and tactical training for other compound occupants, and that Leveille and Morton attempted to recruit others to their cause.
"The superseding indictment also charges Leveille, Siraj Ibn Wahhaj, and Morton with conspiring to attack and kill officers and employees of the United States, in violation of 18 U.S.C. § 1117. It was a part and an object of the conspiracy that the defendants would kill officers and employees of the United States, specifically, Federal Bureau of Investigation employees, government officials, and military personnel."

"Last week, Rafael Orozco pleaded guilty in several cases, including when he prompted a lockdown at Holy Cross Hospital in 2017 after attacking his wife, who was breastfeeding in front of a male doctor.

Prosecutors agreed to allow Orozco to take part in a two-year drug treatment program instead of prison. Now, a warrant has been issued for his arrest because he didn’t show up for treatment.

Earlier this week, KRQE News 13 asked District Attorney Marcus Montoya why he gave Orozco such a big break. He said it was due to a lack of witness cooperation.

Orozco now faces the full 14-year sentence."
