A Colorado woman who claimed her 7-year-old daughter’s death two years ago was the result of a rare and incurable disease has now been charged with murdering the girl.

Kelly Renee Turner, 41, was charged in an indictment with two counts of murder and child abuse in the August 2017 death of Olivia Gant, Douglas County Sheriff Tony Spurlock said Monday as he praised the various investigators who worked on the case. “While it has been an extremely emotional case, they have investigated all aspects of it with diligence and professionalism.”

Details on how the girl really died remained unclear.

Turner, who was arrested Friday at a hotel in Glendale, Colo., also was indicted on theft, charitable fraud and forgery charges.

She appeared in court Monday and no bond was set, Fox 31 Denver reported.

Last November, investigators obtained a search warrant to exhume Olivia’s body, Fox News learned.

The arrest was a stunning twist in a feel-good story that had received widespread coverage in the Denver media before Olivia died.

Her mother said Olivia suffered from neurogastrointestinal encephalomyopathy, a rare disease causing the body essentially to shut down, a system at a time, and doesn’t have a cure.

The media coverage showed Olivia fulfilling a “bucket” list that included being a cop and a firefighter for a day.

an indictment filed Thursday claims that at least five of Olivia's doctors did not believe that her medical problems were terminal, while some even doubted her initial diagnoses.

The indictment claims that Gant, also known as Kelly Renee Turner, withdrew all of Olivia's medical care, arguing that the humane thing to do was to stop care and allow her daughter to die because her quality of life was so poor.

Olivia died a few weeks later in August 2017 and her cause of death was determined to be intestinal failure.

But according to the indictment obtained by 9Wants to Know, her body was exhumed in November 2018 and a forensic pathologist found no evidence of intestinal failure or 'many of the conditions' that Gant claimed Olivia had been diagnosed with.

Olivia's death became suspicious after her sister, now 11, reportedly fell ill with cancer.

The sister was first treated in 2013 in Colorado, but in 2018 she started to see a new doctor who grew suspicious after Gant claimed her daughter had undergone chemotherapy and radiation treatment for three years in Texas.

The doctor called physicians and hospitals in Texas and learned the girl was never diagnosed with cancer.

In addition to murder, Gant has been charged with defrauding the Medicaid system of more than $538,000 and ripping off the Make-a-Wish Foundation and several other charities that helped Olivia live out her dreams in the last few months of her life.

News of Olivia's illness gained the sympathy of multiple charity organizations and fundraising platforms, including a GoFundMe page which raised $22,000, a bake sale that was held for her and a night for the Gant Girls at Chick-Fil-A.

Olivia was the 'Bat Princess' for a day, a Denver cop and spent the day as a firefighter as one of her final wishes.

Attorneys for a woman accused of murdering her “make-a-wish” daughter signaled Friday that her defense will focus on the conduct of doctors and other medical providers who cared for the girl in the years before her death.

And a lawyer representing the woman’s parents, two surviving children and former husband echoed those sentiments.

The 2017 death of Olivia Gant, a 7-year-old whose “bucket list” of final wishes evoked heart-touching news stories, was originally thought to be the result of multiple diseases.

But according to a grand jury indictment, Olivia’s mother, Kelly Turner, faked her medical issues and ultimately killed her.

Turner’s attorney, Ara Ohanian, is fighting to get all of Olivia’s medical records, including records of internal “peer review” documents where her case was discussed among those who treated her. Between 2014 and 2017, he said in court Friday, it was medical professionals who determined that Olivia’s treatment “was both reasonable and necessary.”

That included a decision to withdraw a feeding tube and to impose a “do not resuscitate” order.

Your honor, this is truly the crux of our defense,” Ohanian said during the hearing.

Judge Herron ordered that the records be turned over to her for review and then she will decide which records should be turned over to the prosecution and the defense.

Kelly Turner, 43, put her head in her hands and wept when District Court Judge Patricia Herron asked how she wished to plead. Turner’s public defender put a hand on Turner’s back and spoke with her quietly. The mother paused for nearly a minute before responding to the judge’s query.
“Guilty,” Turner finally answered, pleading to the charge of committing child abuse and negligently causing 7-year-old Olivia Gant’s death. She went on to plead guilty to two theft charges as well.

Turner was charged in 2019 with first-degree murder in Olivia’s death. Prosecutors accused Turner of portraying her daughter as sick for years, lying about her symptoms and fooling doctors at Children’s Hospital Colorado into providing unnecessary and even life-threatening procedures. The girl died in hospice care in 2017.

DENVER (AP) — In late summer 2017, Olivia Gant cheerfully sang Hakuna Matata from “The Lion King” as she was wheeled into hospice care in Denver wearing purple pajamas. “It means no worries for the rest of your days,” she sang. The 7-year-old died less than a month later.

The video put out by her mother Kelly Turner is one of many clips highlighting the little girl's battle with disease and death, which authorities say was used by her mother to dupe doctors and call for favors and donations to help ease her daughter's pain.

Authorities say Turner spent years fabricating her daughter’s illness, gaining sympathy from television news stories and charitable foundations like Make-A-Wish, which even threw a “bat princess” costume party for Olivia at a hotel that cost $11,000.

The girl's cause of death was first listed as intestinal failure, but an autopsy later found no evidence of that condition. Authorities have not said what killed her but, according to the indictment, doctors went along with Turner’s push to stop feeding her daughter.

On Wednesday in a courtroom in Denver, Turner will be sentenced after pleading guilty last month to child abuse resulting in death, charitable fraud and theft between $100,000 and $1 million, according to prosecutors. Turner had also been charged with several counts of first-degree murder, attempt to influence a public servant and forgery.

Turner is in custody pending sentencing.
 
A state judge in Colorado handed down the maximum sentence to a mother who admitted she faked her young daughter’s terminal illness, raised money off of it, and ultimately caused the 7-year-old’s death.
Douglas County District Court Judge Patricia Herron on Wednesday sentenced 43-year-old Kelly R. Turner to serve 16 years in prison for pumping her daughter Olivia Gant full of drugs and forcing her to undergo dozens of unnecessary surgeries in the lead up to her 2017 death, The Associated Press reported.
Judge Herron sentenced Turner to the maximum 16 years on the charge of child abuse resulting in death. She also sentenced Turner 13 years for the charges of felony theft and charitable fraud, with the sentences running concurrently, the Denver Post reported.

Prior to the sentencing, Olivia’s grandfather, Lonnie Gautreau, read a victim impact statement before the court.
“If anybody spoke up and protected Olivia, she would be here today,” he said through tears, per the Post.

Turner’s attorney, public defender Ara Ohanian, reportedly maintained that Olivia suffered from real medical ailments during Wednesday’s proceedings.

“She is not guilty of murdering her child,” he reportedly said. “The plea we took in this case is negligent child abuse.”

Chief Deputy District Attorney Christopher Gallo took the opposite approach, arguing that Turner was directly responsible for Olivia’s death.

“It is an unfortunate and very frustrating thing that the most insidious of crimes a person can commit are also the most difficult to prosecute and prove,” he reportedly told the court.
In addition to serving her prison sentence, Judge Herron also prohibited Turner from profiting in any way from her daughter’s death.

“Whether that be because of a movie consultation, book consultation or book deals,” Herron reportedly said. “The order is Ms. Turner shall not, and will not for the rest of her life, be allowed to benefit further financially from this case or the facts connected with this case.”
Attorney Hollynd Hoskins, who represents Olivia’s family, said that doctors saw Olivia for “over 1,000 hospital visits” and performed “over 25 unnecessary surgical procedures” beginning in 2012, Pueblo NBC affiliate KOAA reported.
 
Yes, what about the doctors? You would think they would be able to tell when a fucking surgery wasn't necessary. It's hard to imagine they have no liability in this tragedy.
It really depends what kinds of surgery they were doing. Surgeries can be done as preventative measures or on parts that, to the eye, look fine. Her feeding tube would have counted as one of those surgeries. They didnt bring it up, probably because they couldnt prove it in court, but no doubt this woman was making her ill in ways that would have matched appropriate symptoms for how the doctors treated her.

Really a lot of your medical care is based off the symptoms you report + a well educated guess from your doctor. I for example have IBS. There is no test that can definitively confirm that diagnosis. A lot of things are like this. Either theres no 100% sure fire way to confirm or the testing is very very expensive/time consuming/specialized which would make it deemed as unnecessary if all the symptoms and other stuff point in that direction. Think how often you can go into a doctors office and walk out with antibiotics despite them never running a test to see if its bacterial or viral.
 
Many, many years ago a couple of my aunts and uncles got arrested for something. I don't remember what. My one aunt said afterward that they beat her using phone books to hide the bruising. She swore up and down that this beating messed up her foot. She would do this fake limp over the years which every once in a while would switch feet.

She doctor shopped like crazy for years after. Pain meds, sympathy and attention of course. But she was desperate to prove the police had maimed her. Eventually she found some quack doctor that was willing to do a series of exploratory surgeries. One of which fucked up her foot. And she ended up having to get prescription shoes so that both her leg heights would be the same. One shoe has a way thicker sole. And she started out with nothing wrong except in her brain.

She eventually sued that doctor and got a few thousand dollars out of it maybe a decade later. The money was gone in a month and she still limps because she can't afford the funny shoes all the time.

These freaks thrive on sympathy and being a victim. In her mind she is the victim not the daughter.

It also gives them a failure excuse in my opinion. Well I can't work full time, my daughter is sick. I can't get out to pay my bills on time because my foot is so messed up. I never got a chance to be a better person because "bullshit lie" wasnt fair to me. It's not my fault. I'm the victim here.

A 16 year sentence is disgusting. And I truly hope her family completely cuts her off. Like when she gets out it would be nice if no one is waiting for her and she has nowhere to go and nothing to ever look forward to again.

And all the doctors who allowed this shit to progress to actual death are complicit in her murder. They should all be named and shamed at the very least.

Olivia telling her grandfather she was hungry after the mother stopped her from getting any nutrition is horrible and deserved a life sentence without parole. She tortured her child(ren) and really deserved to experience the same treatment.
