Police have arrested and charged a man in connection with the killing of a 5-year-old Fort Wayne boy.

Officers with the Fort Wayne Police Department arrested 28-year-old Daniel Tyrell Pope.

The boy was identified as Benjamin Otto McKinney-Frederick. He died after being taken to a hospital.

According to a probable cause affidavit, Fort Wayne police were called to the home on reports that the child was not breathing on March 8. Pope and the boy’s mother were at the home at the time. Pope found the child lying on the bathroom floor around 12:30 p.m. Pope began CPR while he was on the phone with 911.

The boy’s mother told police that Pope asked her to change the boy’s soiled underwear and clean him up. She said that his body was warm to her touch and his lips were blue, according to court documents.

A doctor told investigators that there was “overwhelming evidence” that the child had been severely abused. According to court documents, his face had been beaten, he had pulmonary contusions consistent with blows to the chest and he had defensive wounds. Additionally, there were wounds on his chest, up and down the left side of his body and on his genitals, the report said.

Initially, the boy’s mother told police that she lashed out at him by hitting him with a belt on his legs and thighs. She also said she is the only person who disciplines him. She said the last time he was disciplined was on March 3.

However, in a follow-up interview with police, she admitted that Pope disciplines the boy by whipping him. She said she witnessed Pope whip the 5-year-old with an HDMI cord and said she physically grabbed Pope’s arm to get him off of the boy. She said she has also heard the boy being choked and said he would call for her help as he was being choked.

She said she is scared of Pope because he also beats her. According to court documents, she told police Pope has punched, kicked and choked her. She said she is scared of Pope and that the abuse has happened multiple times over the last eight months. She said Pope told her to lie to police about who disciplines her son.

McKinney-Frederick died March 12. The coroner during an autopsy discovered the boy suffered from blunt-force trauma injuries including a contused kidney, blood-filled lungs and abrasions under his chin.

The cause of death was ruled to be anoxic encephalopathy due to neck compression and blunt-force trauma.

The doctor confirmed that if he would have received medical attention sooner, the boy would have survived.

The boy’s death was ruled a homicide.

Prosecutors and lawyers for a man accused of beating a 5-year-old boy to death in March want a judge to keep secret Indiana Department of Child Services records that include details about the child's alleged abuse.

That comes as state lawmakers debate a measure that would restrict access to records in child abuse and neglect investigations and after The Journal Gazette published information last year from DCS documents in another case. A judge in that case ruled disclosing the information threatened the defendant's right to a fair trial and ordered jurors from outside Allen County to hear the case.

Daniel Pope, 29, also known as Danial Pope, is charged with murder and aggravated battery in the death of Benjamyn Otto McKinley Frederick, the son of his girlfriend.

His lawyer and prosecutors argue in court documents filed in Allen Superior Court releasing DCS records “risks substantially prejudicing both the state and the defendant's right to a fair trial.” They also argue the release “will prejudice the jury pool to the extent that (Pope) cannot receive a fair trial in Allen County.”

Pope was charged in the boy's death after the child was taken to the hospital, where doctors told police Benjamyn was “severely beaten and has numerous defensive wounds in addition to his brutal wounds on his chest wall and all up and down his left side and on his genitalia,” a probable cause affidavit states.

A man is admitting guilt to his role in the death of a 5-year-old boy.

ABC21 previously reported Daniel Pope called 911 last March, saying 5-year-old Benjamyn McKinney Frederick was lying on the bathroom floor. He was not breathing. The boy died a short time later.

On Wednesday, Pope pleaded guilty to the aggravated battery charge.

The murder count will be dismissed at Pope’s sentencing.

Pope was sentenced to 40 years, with 15 years suspended. He will spend 25 years behind bars and another 5 years on probation.

So while he is sitting in prison for the next 25 years Benjamyn's donor will be fucking and shitting out kids with men exactly like this piece of shit.

Mom admitted to hitting the boy with a belt on his legs why is she not sitting in prison as well.
