I seriously doubt they’re trying to discredit the victim, by stating they found some weed in his apartment, no one cares it had nothing to do with the shooting. Why are they searching his apartment? Why take the weed and list it as evidence. I doubt they took every single item from his apartment.
I have issue with it even being mentioned let alone log it as evidence and release that to the media. Texas is full of Rusty crusty old farts that think weed is the devils salad. While wine, burbon, whiskey etc is nectar from the gods.

This is a crime scene and I do not understand why the police need a warrant to secure/inventory it. Is this standard procedure? Also, even though its existence is irrelevant, I'm not sure how they know the weed actually belonged to him.

I was trained not just as to fight in combat, but also as a police officer and there is no fucking place in the "Force Continuum" where it says to shoot someone just because your commands were ignored without a recognized deadly threat visible. Amber Guyger, the Dallas police officer who faces a manslaughter charge in the shooting death of Botham Jean, has been fired, the Police Department announced in a news release Monday.

Chief Renee Hall fired Guyger, 30, during a hearing.

The news release said an internal affairs investigation concluded that Guyger "engaged in adverse conduct" when she fatally shot Jean at his South Side Flats apartment on the night of Sept. 6.

"Officer Guyger was terminated for her actions," the news release said.

Under Civil Service rules, Guyger can appeal her firing.

The items that were searched include Guyger's cell phone, her online Pinterest account, the Facebook page for South Side Flats, Jean's personal Facebook account, his cell phone and his laptop.

Even with almost a month since the shooting, very few public records in the shooting have been released.

Hell I've done similar (a few times I was actually sober, I shit you not). I've even once tried unlocking my downstairs neighbor's door by mistake.

"This officer was able to find her keys, she was able to locater her car. She was able to locate the direction back to her apartment complex, but somehow she couldn't find her apartment. And these are answers, I think that the grand jury is going to want to know,” said Jean family attorney Daryl Washington.

One of the big concerns for the defense is how much publicity the case has received.

It may only be a formality before Judge Tammy Kemp on Tuesday of scheduling a legal action a few weeks down the calendar. It’s called filing a pass slip. But nothing about the case is just a formality, and nothing about it will likely get a pass from the media and courthouse observers.

“It’s a perfect team,” Milner said. “That’s a very good team.”

Milner expects a flood of media to report on the team's every action until trial.

“I suspect they'll be media from all over the place — not just local and regional. I think there'll be media from everywhere,” Milner said.

The defense will also now be able to get discovery, meaning they’ll obtain copies of what the state has as it relates to the case.

There is likely to be several more basic steps in the case before important motions are filed.
 
Guyger will make another court appearance this Friday at her third announcement hearing.

Court records indicate Guyger’s defense team is looking into the background of the woman who shot video of the pacing, then off-duty Dallas police officer, following the shooting of Botham Jean.

Ronnie Babbs heard the shot and decided to take the video which she then uploaded two days later. The family's attorneys brought it to the attention of the D.A. Babbs started speaking out after realizing there was a discrepancy in Guyger's account, and she couldn't let this slide by.

She is the only witness, so the Guyger's defense is busy digging for any possible dirt on Babbs. Attorneys Toby Shook and Robert Rogers are representing Guyger. They’re now digging into Ronnie Babbs. They've filed subpoena applications with four of her former employers and are wanting to know her employment history and any termination and disciplinary documentation. They also want to know about two theft cases from 2013 and 2012 connected to Babbs. Babbs also gave an interview that they will be watching closely.

I don't know why Babbs would have motive to discredit Guyger, so I'm not sure her background is going to be as big a factor as the defense would have us believe.

Just trying to dig up mud. Video is hard to refute so the only thing left is to make the videographer look bad. The PD tried the same checklist in the hours/days following the shooting to try and justify the shooting. At least her lawyers are attempting the 'vigorous defense' so that shouldn't be one of the reasons to appeal when she's found guilty (provided the DA doesn't hose the case).

The court documents also reveal one witness was told to hand over a copy of the lesson plans for several courses Guyger would have taken during her time at the Dallas Police Academy from 2013 to 2014. Among them were courses on subjects like de-escalation techniques, use of force training and less lethal electronic control device training.

Another witness was asked to speak about Guyger's time card from August 15, 2018, until Sep. 7, 2018, the day after the shooting, the documents state.

The hearing was just one step in the process of gathering more evidence and witness testimony in the case.

The Dallas Police Department is launching an internal investigation after a Dallas television station obtained the 911 call made by an off-duty officer who fatally shot a man in his own apartment.

WFAA-TV aired the entire 911 call Monday night from now-former Ofc. Amber Guyger the night of Sept. 6 when she entered the apartment of Botham Jean and shot him dead. The station didn’t say how they obtained the recording.

Police officials said Tuesday they still have not authorized the official release of the 911 call [....]

New documents submitted by attorneys on both sides of the Amber Guyger murder trial reveal some of the main issues that may come up in court.

In the new documents, both sides appear to be anticipating certain issues about Guyger's character and her use of deadly force that might be brought up during trial and need to be discussed before being heard by a jury.

A new motion by the state says "the defendant will argue that her use of deadly force was justified as deadly force in self-defense." But the state says that argument requires reasonable "belief that would be held by an ordinary and prudent person in the same circumstances."

Criminal defense attorney Todd Shapiro is not involved in the case. He says the state may want to portray Guyger as a normal citizen who's held to the same standards as everyone else.

“Would an ordinary person in these circumstances have reacted in the same way that Ms. Guyger reacted? Would they have used the same amount of force?” Shapiro said. “Would they have reacted the same was as she did as opposed to a police officer reacting in the way she reacted?”

Another motion filed by the defense pleads for 'character trait evidence' to be allowed in court possibly to show committing a murder is not in Guyger's character.

“It seems from some of the things they’ve filed there may be some specific character traits they want to be able to get into about her that would shed some light on some positive character traits that may say she’s not the type of person that would’ve committed this kind of act,” Shapiro said. “That she’s not the type of person that would’ve committed a murder.”

Attorneys on both sides argue all these issues need to be heard outside the presence of a jury first in order to decide if they'll be allowed in court.

The judge has cast a wide net for potential jurors in this trial, more than anyone can remember.

About 4,000 Dallas County citizens have been summoned to appear Friday morning as the jury selection process gets underway.

The former officer, now defendant, Amber Guyger, her legal team, and prosecutors will be in the central jury room at Frank Crowley Courthouse as the process of picking the jurors to weigh the evidence in this trial begins.

Thousands of jury summons were mailed out, but for various reasons, only 500-600 are expected to show up.

“We have summons that go out to faulty addresses, so people don’t ultimately get them. We have jurors exempt for whatever reason; age, military. And unfortunately, nationwide, we have a problem with people just not honoring their jury summons,” jury consultant Kacy Miller explained.

Miller has more than 20 years of experience as a jury consultant.

She was able to discuss the Guyger trial because she is not working for either side.

“And the judge will present to them a written questionnaire. Could be a couple of pages, might be as many as five, might be as many as 10,” Miller said.

The carefully crafted questionnaire is designed to get more information about the possible jurors.

“Looking for jurors who might have a bias or prejudice against one side or the other that will potentially make them ineligible,” Miller said.

The pool of jurors will fill out the questionnaire, and leave that in the jury room.

Judge Tammy Kemp, who is presiding over the case, and lawyers for both sides will go through those answers and whittle down the number being considered to serve on the jury.

“This case has had a lot of attention, both in social media, especially print media, television media,” Miller said. “The parties need to identify jurors who have had exposure to that, but exposure to the media does not necessarily excuse a juror from serving.”

Those chosen - maybe 200-250 – come back September 13 to answer questions from the attorneys in what’s called “voir dire,” which means: to seek the truth.

“And it can be an uncomfortable process for jurors if they don’t understand the purpose of it, because it feels like people are interrogating them. And you’re in a room with 250 of your new best friends and being asked to comment on sometimes topics that are uncomfortable, or politically or socially sensitive,” Miller added.

Based on “voir dire,” Judge Kemp will determine if a fair and impartial jury can be seated, before moving ahead with any change of venue hearing which was requested by the defense.

“I think it shows me she has faith in the jury system, faith in Dallas County jurors, and has a high hope that by summoning such a large number and allowing a written questionnaire and probably extensive oral “voir dire,” that she and they can seat, in fact, an impartial jury,” Miller said.

Man, I'm glad I didn't receive one of those summons. I usually do just ignore them, but that would be risky in such a high profile case and it would give me some satisfaction to help put this cunt away. Most of all, I want to know what really went down because her story is shit.
