A Tennessee man fatally beat a 4-month-old boy after finding out the infant wasn’t his son, police said.

Jose Avila-Agurcia, 33, of Memphis, is facing a charge of first-degree murder in perpetration of aggravated child abuse in the April 12 death of Alexander Lizondro-Chacon, who he thought was his son, the Commercial Appeal reports.

Cops responded to a residence on Court Avenue and found the boy’s mother, Mercy Lizondro-Chacon, who said the infant was having trouble breathing. He was then rushed to a hospital, where he was pronounced dead from blunt force trauma to the head, according to an affidavit of complaint.

The boy also had pneumonia, as well as a fractured skull and rib. Lizondro-Chacon and Avila-Agurcia then gave statements to investigators two days later indicating that they cared for the infant, but had no idea how he became injured, according to the affidavit.

Avila-Agurcia later emerged as a suspect in the boy’s death after Lizondro-Chacon told detectives that he admitted striking the baby several times in the head because he was enraged that he wasn’t the boy’s father, the affidavit states.

The Shelby County medical examiner has ruled the boy’s death as a homicide, WREG reports.

The man, identified by local authorities as Jose Agurcia-Avila, was charged with first-degree murder in perpetration of aggravated child abuse and first-degree murder in perpetration of aggravated child neglect.

However, U.S. Immigration and Customs Enforcement later said that name was an alias — the man’s real name is Carlos Zuniga-Aviles, and his identity was confirmed through biometrics. They said he is a Honduran national in the country illegally, and he has been removed from the country five previous times.

Through a translator, an acquaintance of the mother who was at the apartment Wednesday said she was there when the mother got the heart-wrenching news.

“She pretty much touched the kid and told her that the kid was dead, and she … became crazy,” the woman said. “(She) was crying. She never thought this could happen to her because her kid was healthy.”

Carlos Zuniga-Aviles, a 33-year-old Honduran national, has used multiple aliases, including the fake name of Jose Agurcia-Avila he gave police in Memphis, Tennessee, following his arrest in the boy’s death earlier this month, US Immigration and Customs Enforcement officials told WMC-TV

ICE officials have since filed an immigration detainer against Zuniga-Aviles, who was initially deported back to Honduras in February 2010. He was also returned to the Central American country in 2011, 2012, 2015 and 2016.

“ICE will seek to take him into custody to reinstate his removal order following the resolution of the criminal charges he currently faces,” the statement reads. “Mr. Zuniga-Aviles has been removed from the US five prior times: his most recent removal by ICE to Honduras took place in December 2016.”

Zuniga-Aviles later returned to the U.S. following his removal, a felony under federal law, immigration officials said. It’s unclear exactly when he returned, but he was living with his girlfriend and the woman’s 4-month-old son in Memphis at the time of his arrest, WREG reports.

So wait did I read that right? He gets a 10 year sentence for abusing the baby but only a 2 year probation for killing him?
 
With the cheap costs of DNA testing, hell I did mine mail order, why not start making the tests mandatory at birth? There have been cases of cuckold men finding out their spouses cheated and hung that baby around their neck. Because they filled the "father figure" role they were stuck on child support regardless of the fact their partner cheated. There are laws in effect in most states related to this to keep the kids off state dole. Laws need to change and we have the technology now to make sure it happens.
