A DeLand man was arrested for beating his mother who could not pay him back the $100 he loaned her when he asked for it, police said.

Giovanni Bubenik, 23, was charged with two counts of battery on a law enforcement officer, aggravated battery bodily harm, and assault.

According to a charging document, officers were called to a home around 12:41 a.m. Monday where they saw Bubenik’s sister run toward them crying, saying Bubenik was beating up her mother.

Bubenik told police that his mother was having money issues and hit him with a bat while he was on a couch playing a video game, a report shows. But when police spoke to the mother, she informed police that she had borrowed $100 from her son and that Bubenik contacted her earlier in the day demanding it back, a report states.

The mother told her son she would give him the money when she had it, but Bubenik came to the home later and started arguing with her, police said.

The mother went outside to smoke to relax and Bubenik locked her out. The mother had to grab a bat and break some wood covering a window to get inside, investigators said.

As the woman climbed in through the window, Bubenik threw his mother to the ground, police said.

The daughter, who called 9-1-1, told police she saw Bubenik throw their mother down and then stomp on the back of their mother’s head, a report detailed.

Both the mother and daughter said the mother had to grab Bubenik’s face and scratch him in self-defense, police said.

DeLand police said that when Bubenik was arrested, they noticed scratch marks on his face but Bubenik had no signs of being hit with a bat.

And as police escorted Bubenik out of the house, he battered them, a report said.

“Giovanni (Bubenik) then turned around, snorted his nose to build up mucus and spit on my left cheek,” the arresting officer wrote in his report. “When he spit, he struck Corporal Tagle in the right ear with mucus.”
